Word has been received of the ar
rival of Charles Hamrick, E. Kennedy,
B. King and A. Penninger, former
B. I. students, at Newport New^, on
the Manchuria, from Brest. These
boys were all in the 81st Division.
John Hamrick and Roy Holland who
were in the navy, have both been dis
charged and are at their home in For
est City.
George Smith of the 603rd Engin
eers is also reported to have arrived
in thi? country.
Miss Lucy Poindexter of Winston-
Salem is visiting her sister. Miss E.
Poindexter at the Institute.
CEDAR NT. NOTES
Rev. Osborne McCall was accom
panied by his wife to Cedar Mt. where
he preached 3 very interesting ser
mons. One on Friday night one->on
Saturday afternoon and one on Sun
day afternoon.
Miss Lessie Heath has gone to
Greenville for a few weeks.
Mr. Alexander Burns and daughter,
Alice, have been visiting Mrs. Sum-
mey of East Fork.
Grace Jones is spending a few
weeks in Greenville.
Ben Lewis of Greenville has rent
ed the Hill Cottage for a month.
Mr. and Mrs. McClure and Miss L.
Heatle motored from Greenville to
Cedar Mt. Sunday.
Dan Henderson of Aiken spent the
week-end with his wife and daughter.
Miss Jennie Bishop is on the sick
list.
Miss Myrtle Hamlin, who spent the
winter near Aiken, S. C., came home
some time ago to spend the summer
here.
E. Jones, who has been in the army
for over two years, got his discharge
last week.
The parents of Ellison McCrary
have recieved news that he has land
ed in America. He was the first
boy in Cedar Mt. to enlist after the
war broke out. He went over with
the 81st Division.
France McCrary left two weeks ago
for Texas.
Mr. and Mrs. Osteen from Crab
Creek were visitors in Cedar Mt. re
cently.

against the said defendant on the
23rd day of June, A. D. 1919, by the
Clerk of the Superior Court of Tran
sylvania County, North Carolina, and
that an action entitled as above has
been brought by the above named
plaintiff against the s.aid E. H. Jen
nings to recover damages for a breach
of contract on the part of said defen
dant, and to recover damages for the
negligence of the defendant by reason
of which breach of contract and neg
ligence certain real estate and prop-
perty of the plaintiff situated in Tran
sylvania County, North Carolina was
injured and damaged by the said de
fendant, and also that said action is
brought for the purpose of compelling
defendant to rebuild and restore a cer
tain dam in Transylvania County and
the lake formed by said dam, usually
known and referred to as “Lake Tox-
away,” and also to maintain the same,
which said dam was necessary and
useful to the plaintiff, and in which
the plaintiff claims certain property
rights, that said defendant is a proper
party to said action which relates to
real estate situated in the County of
Transylvania and State of North Car
olina and said defendant will further
take notice that he is required to ap
pear at the next term of Superior
Court of Transylvania County, North
Carolina, to be held on the 6th Mon
day before the first Monday in Sep
tember, 1919, at the Court House in
said County, and answer or demur to
the complaint in said action or the
plaintiff v/ill apply to the Court for
the relief demanded in said complaint.
The defendant will also take notice
that warrant of attachment was issu
ed from the Superior Court of Tran-
, sylvania County, North Carolina, on
j the 23rd day of June, 1919, against
the property of said defendant which
said warrant is returnable at the time
