ORDERED AND RULED THAT:
All Dogs in Said County, if allowed to run at
large, should be properly muzzled unless accompan
ied by the owner of such dog or dogs at large. If
not so muzzled all dogs in the county shall be secur
ely confined to the owners premises.
FAILURE TO COMPLY
With this order of the Board of Health shall
be a misdemeanor and any person or persons con
victed of such misdemeanor shall be liable to a fine
of Fifty dollars or confined in the County Jail for
thirty days.
IT SHALL BE THE DUTY OF ANY OFFICER:
Of Transylvania County to kill any dog Or dogs run
ning at large unmuzzled or not accompanied by
owner or owners.
Further, any citizen of said County shall have
the right to kill any such dog or dogs.
THIS ORDER SHALL BE IN FORCE
In Transylvania County for ninety days from
this 14th day of May 1921, and may be extended
or reinforced at any time in the discretion of the
County physician or health officer.
REVISAL 1908, SECTION 3305:
‘‘If the owner of any dog shall know or have
good reason to believe, that this dog, or any dog
belonging to any person under his control, has been
bitten by a mad dog, and shall neglect or refuse
immediately to kill the same, he shall forfeit and
pay the sum of fifty dollars to him who will sue
therefor; and the offender shall be liable to pay
all damages which may be sustained by any one,
in his property or person, by the bite of any such
dog, wd shall be quilty of a misdemeanor, and
fined not more than fifty dollars or imprisoned not
more than thirty days.”
