Water Ordinaiu it > SECTION 1. That any persons re siding within the corporate limits of the town of Brevard, and desiring to do so, may take or use the town water within the said limits of the town up on paying. the ,ehai*ea or meter rates specified in the oraintfnce;' provided, however, that the said person or per sons shall comply in all other respects with each and all rule* and regula tions prescribed by. or that may , hereafter be sopted by the Board of Aldermen of the Town of Brevard, relative to the use of said water in any manner affecting the same. SECTION 2. The application for a connection to the water mains and for the use of water must be- signed by the owner of the premises to be supplied or his, her or their duly au thorized agent on the proper form provided for that purpose. An appli cation signed by the tenant only will not be considered. SECTION 8. All applications for the use of the town water must be made on proper forms to tha Collector of water rents. SECTION 4. Town water supplied to consumers outside of the town limits shall be at a rate of fifty per, cent higher than the minimum rate or charge prescribed by this ordin ance for consumers within said town limits; provided, that the Board of Aldermen reserves the right to re fuse to allow any person residing out aide of said town limits to connect with the water' mains or use the 1 town water by any means whatever, ' and further reserves the right to dis* , continue service to any or all outside ' consumers in cases of water short age. (I SECTION 5. That all bills or charges for the use of the town water .shall be due and payable at the office ! of the Collector, monthly, in advance and must be paid on or before the I tenth of each and every month in each 1 and every year. Upon the failure of ! any consumer of the town water to comply with the requirements as to 1 the payment of charges for the use 1 of water as set out in this section, or 1 for the violation of any rules and ! regulations set out by the Board of 1 Aldermen concerning or regulating 1 the use of said Water the Collector is J hereby authorized, empowered and j required to instruct the employees of ' the Water Department to deprive c such consumer of the use of said ' town water by cutting off the same c unless and until said deliquent con- T suuicr or property owner shall pay ' such charges on said account as may be due, and shall pay in addition e thereto the sum of one dollar to v cover all costs that may be incurred 1 by said failure to comply with any of c the other provision of this ordinance. The monthly charges J for water, payable on or before the tenth day of each month in advance, .shall be as follows: On all dwelling houses up to and | including six rooms .... $1.00, ? and an additional charge of ten cents per room per month above this number. On all Barber Shops, First Chair ' $1.00, all over one, fifty cents 11 per chair. -s The Board of Aldermen reserve c the right to install meters on all in- } dustrial plants, wash racks, or any ?' other consumers using water for . train, and the following monthly char- 1 ges will be made: First 15000 gallons, 25 cents per > 1,000 gallons. c Next 25000 gallons, 20 cents per 1,000 gallons. c Next ."S5000 gallons, 15 cents per <? thousand gallons. All over 75,000 gallons, 10 cents \ per 1,000 gallons. \ SECTION 8. Whenever it becomes i necessary to enter any premises, i stores or dwellings to inspect any ; water pipe fixtures, meters or ap- . plianees, etc., the superintendent in- J spcctor or other authorized employee I or agent of the said town shall make ' demand at a reasonable hour for the i right of inspection, and should the i said superintendent, engineer, in- i spector or other agent or employe of the said town, authorized so to enter said premises or dwelling, be op posed or refused admittance in the performance in his or their duties, the party or parties so opposing will for feit and be liable to a penalty of ten dollars, and shall be guilty of mis demeanor, and the supply of water . to said property* may be cut off un til such examination is made and the required information is obtained, or repairs and alterations are made. SECTION 0. A separate cut-off shall be put in for each meter or connection, so that the same may be cut off independently, and in all cases yvhere this is done these cut offs shall be in the street; provided, however, that when the supply is taken through one meter or connec tion upplying two or more houses, all owned or controlled by one party, a separate cut-off may be placed in an adjoining yard through which the water passes before reaching the house or premises supplied, by which the house may be cut off indepen denty. Said cut-offs will only be placed on the written application of the property owner, approved by the Water Committee, and any inter . ference therewith to be punished ac cording to the laws governing the same as if it were placed in the street. In no .case will said cut-off be allowed^ to be handled by any other than an employe of the Water De partment. All expenses of placing and keeping or repairing of aid cut-offs shall be borne by the property owner. When water ia cat off by the Water Department and ia afterwarda found to be turned 'on without the know* ledge of, said department, then the ss'i amount of water rent collected. In no caae will these cut-offa be placed within the premisee when the houses supplied have a ftontago on a public street or alley. In such cases these special cut-offa must be in the saVi street or alley. . SECTION 10. All meters installed shall be located only on tho approval meter reader, inspector or other au thorized employe of the Water De partment SECTION/11. A stop and waste cock, or cut-off valve, must be in stalled by property owner in a con- ' venient place and to 'be for the con venience of the property owner- in \ case of breaks or other necessity i whereby pipes to be repaired can be cut off without the necessity of using ; the street corporation cut-off. As j many additional stops or waste cocks as desired by the owner may be placed i within the premises to be used ac- ] cording to desire or convenience. ( SECTION 12. Unauthorized per- ' ] sons who may interfere with the j valves or cut-offs of the street mains j or curb-cocks, or any part of the 1 1 water works system, shall be guilty j ot a misedemeaner, and upon convic- i tion in the court shall be liable to a i penalty of fifty dollars. Plumbers, i duly licensed, may in case of accident I shut off the water at" curb-cocks. ; < SECTION 13. A uniform charge ' will be made to cover the cost for j > making all domestic taps for the 5-8 p nch connection in addition to the i ?harge for running pipe to property ? ine where property is located on * :own water-line. In all cases where f rieter i^to be installed, same will be c furnished by the town and charged c o consumer at actual cost, or a min- " ? mum meter rent will be charged I nonthly. Meter box, curb-cock and i ill other fittings will be included in I otal charge and water will not be o urned on until the total of said e iharge is paid. Should any person P ise water without the knowledge of ^ he Water Department, a bill will be iiade against the premises for the '? ime the water was used, or the ' luantity shown to have been used bv <' he nieter, and the water turned off ind not turned on until the bill is P ettled together with one dollar C h:\rge for cutting off and on. Plumbers must make eturn to the Water Department up in the reverse side of the permit, and ^ nust specify in full the various fix* ures he has put in, alsb the location 0 ?f the stop and drain cock by which c 'ic property owner may shut off the ? vater. No meter shall be I removed or disturbed without permis- i :;ion of the Water Department. SECTION 19. The town will not be liable for any damage that may re sult to consumers for shutting off a water rr.nhi or service for any cause whatever, even in case where no no notice is given and no reduction from water bills will be made there for. Premises alr-acly .supplied with town water are subject to the rules regarding meters, meter . boxes, stop-cbcks, curb cocks and boxes in the same manner as new 'customers. All water passing through meters whether used or wasted will be charged for. SECTION 21. All pipes leading from the town lines and mains are to be laid at a depth specified by the Water Department or City Engineer, and shall be lead or galvanized iron. SECTION 22. The town reserve* the right to make all^aps and fur nish all connections up to the prop erty line, and to charge for the Mine In addition to the time and labor for placing same, to the property owner. SECTION 23. No person shall be allowed to tap any water main or connect any town water lines except after making application and receiv ing permit from the Water Depart ment, and no plumber- or other per son shall be allowed to tap any of said mains until he shall have given to the town a justifiable bond for the sum of two hundred dollars to idem Bify the town against any damages he may do to said mains, such as cracking or breaking the same in making taps. The application for all connections for buildings in course of construction and charges for use of town water therein shall be made to the Water Department, who shall fix ?aid charges and make special regu lations covering the same, if neces sary. SECTION 24. That it shall be un lawful for any person or persons sither within or without the corpor ate limits of the town, using water supplied by the town, to permit or allffvr any spigot- or other opening to remain open, thus allowing water to waste for the purpose of preventing water pipes er fixtures from freez ing, or for any other purpose. Any person or persons violating any of the provisions of this ordinance shall be guilty of a misdemeanor, and on conviction, shall be fined the sum of five dollars for each and every of fense. It shall be the duty of all em ployees of the Water Department and the members of the Police De partment, to diligently search for ind report any and every violation of ?ny of the provisions of this ordin ince. SECTION 25. The town reserves he right to have inspections made of ill fixtures in each and every build ng wherein town water is used, and vhere leaky spigots or other fixtures ire found, water will be cut off and tervice will be discontinued until all luch fixtares are repaired, and in iach and every case a charge of ono j lollar will be made for cutting off and i in.
