The defendant corporation above
named will take notice that a sum
mons in the above entitled action
was issued against said defendant
on the 21 day of August, T946, by
the Clerk of the Superior Court of
Haywood County, North Carolina,
for the sum of $7,362.50, due the
plaintiff by the defendant for
breach of contract by the defend
ant with the plaintiff on a timber
contract whereby certain timber
and timber products were to be
cut and removed by the plaintiff
from the lands owned by the de
fendant corporation, and for monies
expended in building roads and
necessary ways and means whereby
said timber and timber products
could be removed from said bound
ary. The defendant will take notice
that a Warrant of Attachment was
issued by said Clerk of the Su
perior Court at the time of the
issuance of said summons and pur
suant thereto the Sheriff of Hay
wood County, North Carolina, lev
ied upon and attached the following
property belonging to the defend
ant, to-wit:
Two tracts of land in East Fork
Township, Haywood County, North
Carolina, the first containing 1200.9
acres, and the second containing 50
acres, making a total of 1250.9
acres, and being the identical tracts
of land conveyed to the McCreery
Land & Investment Company, a
corporation of South Carolina, by
G. T. Pressley, Trustee, by deed
dated September, 1927, and re
corded in Book No. 75, page 379,
Office of the Register of Deeds for
Haywood County, North Carolina,
and being also the identical tracts
of land conveyed to Flowers Hold
ing Company, a Corporation, the
defendant herein, by the McCreery
Land & Investment Company, by
deed dated June 27, 1936, and re
corded August 21, 1936, in Book
No. 96, page 289, Haywood County
Registry, to which said deeds and
records reference is hereby made
for a full and complete description
of said lands, and said descriptions
are hereby incorporated herein by
reference as fully as if set out
herein.
Which said Warrant of Attach
ment is returnable before the Clerk
of the Superior Court of Haywood
County, North Carolina, at the time
and place named for the return of
the summons.
The defendant will further take
notice that it is required to be and
appear at the Office of the Clerk
of the Superior Court of Haywood
County, North Carolina, at the
Court House in Waynesville, North
Carolina, on or before the 18th day
of November, 1946, or within thirty

HACKENSACK, N. J Charles
Tressler Lark, New York lawyer,
who died two weeks ago, was an
authority on wills and estates and
had the reputation of never having
had a will broken by contest dur
ing his long career.
But today his own will was re
jected by Donald G. Dutcher, Ber
gen county surrogate, who explain
ed that the document, entirely in
tho handwriting of Mr. Lark, had
not been witnessed. Such wills
are not admissible in New Jersey,
Mr. Dutcher said, except when
drawn on the field of battle.
The will of Mr. Lark, who lived
at 99 Prospect avenue here, was
made in 1918 and bequeathed his
estate to his wife, Mrs. Blanche
Good Lark. Mr. Dutcher sent let
ters of administration to Mrs. Lark,
who will now receive a third of
the personal property. The rest
will go to the couple's three chil
dren.
The first will drawn by Mr. Lark
was that of Mark Twain.
COTTON
By this time the 1947 cotton crop
is harvested, the large surplus of
cotton which existed in the Thir
ties, with its consequent headache
for farmers and government offi
cials, will have disappeared, ac
cording to the Department of Agri
culture. Indications are that the
domestic carry-over of American
cotton on Aug. 1 is the lowest since
1929, a little over '4,000,000 bales
compared with the 7,500,000 on
Aug. 1, 1945.

The Mayor and Board of Alder
men met in special session at the
Major's office at 7:30 P. M. on
Thursday, September 5th. 194G, to
consider the matter of establish
ing building lines on certain streets,
and a map of the streets as here
inafter designated, prepared by W.
H. Terrell, C. E. as directed by the
Board, was submitted and consid
ered, which map showed the build
ing lines desired to be established
by the Board and as pointed out by
the said W. H. Terrell, Engineer;
and it appearing to the Board that
it is necessary for the bettor inter
est and safety of residents of the
Town of Waynesville to establish
building lines along the strtcts as
shown on said map of the said W.
H. Terrell, as hereinafter set forth;
It is, therefore, upon motion of
W. II. Massie, duly seconded by
L. M. Kilhan, that an ordinance
presented by the town attorney be
adopted establishing said building
lines, which ordinance is in words
and figures as follows:
BE IT ORDAINED by the May
or and Board of Aldermen of the
Town of Waynesville as follows:
Section 1. That it is necessary
for the best interest and safety of
the Town of Waynesville to estab
lish building lines along the sides
of streets as hereinafter designated.
Section 2. That said building
lines be established as shown on
the map and survey of W. II. Ter
rell, made January 194G, and tiled
with this ordinance, on the streets
as therein set forth, as follows:
(a) That on both sides of Hay
wood Street, between Church
Street and Depot Street, the build
ing lines shall he. and the same
are hereby established ;is being
twenty feet back from the inside
curb lines on said street, and run
ning parallel with said curb line
on both sides of said street from
Church Street to Depot Street,
(b) That the building line be
established on the Northeasterly
side of Miller Street between Main
Street and the Southern Railroad
on a line parallel with and twenty
feet back from the curb line of
said street on the Northeasterly
side thereof.
(c That the building line shall
be and the same is hereby estab
lished on the Southwest side of
Montgomery Street between
Church Street and Depot Street at
a point fifteen feet in a South
westerly direction back from and
parallel with the curb line of said
Southwest margin of said Mont
gomery Street.
(d That the building line be,
and the same is hereby established
on the North side of Church Street
between Haywood Street and Mont
gomery Street on a line parallel
with and twenty feet Northerly
back from the curb line of Church
Street, as now located.
Section 3. That it shall be un
lawful for any person, firm or cor
poration to build, construct or
cause to be built or constructed any
building or structure of any kind
between the building lines as estab
lished herein and the curb line of
said streets along which said build
ing lines are established.
Section 4. That it shall be un
lawful for the buHding inspector or
anv other oerson to Issue or gram
any permit to any person, firtn or
corporation for the construction ot
any building extending over and
hetween the said building lines ana
streets, as herein designated.
Section 5. That any person, firm
nr romoration violating any of the
provisions of this ordinance hall
be guilty of a misdemeanor. (
Section 6. That this ordinance
shall be in full force and effect
from and after its ratification.
The foregoing ordinance, upon
motion duly seconded, was unani
mously adopted on its first reading
by the Mayor and Board of Alder
men. Upon further consideration the
foregoing ordinance was. up mo
tion duly seconded, passed upon its
second reading, and ordered to be
published in the Waynesville Moun
taineer. The foregoing ordinance was
passed unanimously on its third and
final reading at regular meeting of
the Mayor and Board of Aldermen
of the Town of Waynesville held
at 7:30 P. M. on the 10th day of
October, 1946.
