LAW For Laypersons North Carolina's law requiring its State drivers to be responsible for placing their children in a restriant system in their car will become effective July 1, 1982. It will apply to all licensed North Carolina drivers who are operating their own motor vehicle or family purpose vehicle and who have as passengers in their own cars children who are two years old or younger. The restraint used by North Carolina drivers must be one that is approved by the North Carolina Commission of Motor Vehicles. There are several instances when the act does not apply. For exam ple, if the child is not occupying a position where seat safety belts are required by federal law, there will be no need to place the child in a safety restraint system. In addi tion, if the child is one year or older and is secured by a safety belt already installed in the car, the act will also not apply. If the vehicle is registered in another state or if the vehicle is an ambulance or an emergency vehicle, the act will again not apply. Finally, if the child's personal needs are being met or if all positions equipped with passenger restraint systems or safety belts are occupied, the act will also not apply. From July 1, 1984 until June 30, 1985, a fine of S10 will be levied against violators, but a violation will not be accompanied by the assessment of insurance points. When June 30 of 1985 rolls around, it will be interesting to see ' whether North Carolinians have complied willingly with this new act and whether the act is effective in doing what our legislators hoped it would do; reducing death and in jury to children in car accidents.
