Service - Personnel Warner Hall Pvt. Warner Hall, son of Lucella Hall of Rt. 1, Shannon, has completed basic training at Fort Benning, Ga. During the training, students received instruction in drill and ceremonies, weapons, map read ing. tactics, military courtesy, mili tary justice, first aid, and Army history and traditions. Hall is a 1972 graduate of Magnolia High School, Lumber ton. Navy Torpedoman's Mate 3rd Class Garland T. Hunter, son of Garland R. and Jessie M. Hunter of 3053 Rich Ward Place. Raleigh, and whose wife, Gloria, is the daughter of Harry and Ann Stephens of Rt. 3. Box 252-B, Raeford. recently returned from a deployment to the Mediterranean Sea and the Persian Gulf. He is a crewmember aboard the destroyer USS Briscoe, homeported in Norfolk. Va. During the five-month deploy ment. his ship participated in various exercises with other 6th Fleet units and those of all nations. The Briscoe served as part of the Navy's five ship Middle East Force. Its mission was to provide the capability of the Naval Tactical Data System, a computer method to enable coordinated tracking of air and surface contacts. The Briscoe is 529 feet long and carries a crew of 296. It is armed with guns, missiles and anti-sub marine weapons. LAW For Laypersons It's always embarrassing to find that you have written a "rubber check." a check that "bounces" because your bank does not pay it when it discovers that there is not enough money in your account to make the check good. Suppose you gave the check to the grocery store. The check would be returned to that grocery store, and someone at the grocery store would soon notify you^hat they were holding a check which had been returned to the store unpaid. Your immediate reaction would be to pay the store immediately in cash and get back the unpaid check. When you actually give the cash for the unpaid check, you shouldn't be surprised if the manager of the store asks you for $10 more than the amount of your check. At the same time he asks you, he might point out to you a sign on the cash register stating that a fee of S 10 will be charged for returned checks. If you think about it. you have probably seen many of these signs in various stores in North Carolina as you have waited in checkout lines. You may have wondered what authority the stores had to require that fee. The North Carolina General Assembly in July of 1981 passed General Statutes ? 25-3-512 which authorizes a processing fee, not to exceed S10. to be charged and collected for checks on which payment has been refused because of insufficient funds or because the writer of the check did not have an account at that bank. The right to charge this fee, however, is con tingent upon the store's posting conspicuously or in the immediate vicinity of the cash register in plain view of anyone paying for goods or services by check a sign no smaller than 8 by 1 1 inches and stating that the amount of S10 will be charged as a processing fee for returned Checks. Suppose you send your check by fnail and never see this particular Sign at the cash register? ? 25-3-512 provides that this same processing fee may be collected only if you and the seller to whom you sent the ctieck by mail had agreed that such < processing fee could be charged if your check came back unpaid.
