UNDER AND BY VIRTUE OF
the power and authority contained
in that certain Deed of Trust ex
ecuted and delivered by Donald F.
Hales and wife, Betty Sue Hales,
dated January 28, 1971, and
recorded in Book 160 at page 407
in the office of the Register of

Carolina, and because of default in
the payment of the indebtedness
thereby secured and failure to
carry out and perform the stipula
tions and agreements therein, con
tained and, pursuant to demand of
