Raleigh, Sept. 3—Flood condi
tions to the Asheville, Boone,
North Wilkesboro, Elkin and
other sections of the west, then
in the Roanoke Rapids, Weldon,
Williamston and other areas in
the east, caused waiving of rights
and record-time decision of the
State Unemployment Compensa
tion Commission to determining
rights of workers in mills and
plants in which work stopped as
a result of the floods.
Also, it brought into the lime
light an amendment to the Un
employment Compensation Law,
adopted by the 1937 General As
sembly, which prohibits payment
of unemployment benefits to
claimants "if unemployment is
due to a fire, where found by the
Commission to constitute a catas
trophe, a flood, a cyclone, a tor
nado or other catastrophe**".
The Commission, within six
days after the floods began to

area, on August 21, rendered a
decision which held, in effect, j
that while the mill or plant was
not operating because of flood
waters in the buildings, then the
workers were due to
the flood; but from the day on
which the flood waters had sub
sided, then the flood "ceased to
be the efficient, immediate or ac
tive cause of the claimants' un
employment and thereafter said
unemployment was not due to a
flood." The decision ordered that
the claims of such unemployed
workers be processed and that
they be paid such benefits as they
are entitled to under the law, if
otherwise eligible.
Employers involved waived
their rights of time allowed for
appeals to order that test cases
might be disposed of expeditious
ly, and to most cases agreed that
benefits should be paid to their
employees under such conditions,
even though a strict interpreta
tion of the law would raise the
question of whether or not they
are eligible for benefits, and even
though such benefits are charged
to the employers' individual ac
count and have a bearing on their
record under the State's "Merit
Rating" system.
The decision, to effect, allows
payment after the waters sub
side, even if it should take weeks
or even months to get the mills
or plants and their machinery to
condition to resume operations.
It was reached after conferences
with Governor Hoey, Attorney
General McMullan, Social Securi
ty Board officials and employers
involved, based on the logic that
the workers are or were unem
ployed "through no fault of their
own."
The N. C. Unemployment Fund
had a balance of $21,806,740.53 as
of July 1, 1940.

Tobacco Growers Warned to
Expect Additional Loss in
Foreign Sales
SITUATION EXPLAINED
Washington. North Carolina
tobacco growers Monday were
warned by the Department of Ag
riculture to expect additional and
permanent curtailment of their
export market.
Casting a cloud over the unex
pectedly favorable domestic to
bacco situation, the department
asserts that three major factors
are expected to decrease sales of
flue-cured leaf to Great Britain.
These factors are:
Plans of British manufacturers
and of the recently appointed to
bacco controller to require at
least four per cent, of Turkish
and Greek tobaccos in all British
tobacco mixtures in 1941 and af
ter that eight per cent.; to stop
all advertising of cigarettes as
"pure Virginia," and to limit to
bacco consumption.
In the past about 99 per cent,
of all cigarettes sold in the Uni
ted Kingdom have been entirely
flue-cured leaf—by far the great
er part of them of United States
flue-cured and advertised as "pure
Virginia." Elimantion of the term
from all advertising will not only
cover the admixtures of Turkish
and Greek tobacco, but may re
sult in use of empire flue-cured
in brands that formerly were
straight U. S. flue-cured.
The cost to manufacturers for
empire grown leaf, as a result of
duty preference and in some cases
lower prices at the source, is 40
to 50 cents per pound less than
'for U. S. leaf. This price differ
ence and the narrower profit
margin under which manufactur
ers must now operate, tend to en
courage use of empire grown flue
cured.
London expects that in 1941
leaf withdrawals from bonded
warehouses are to be limited to 90
per cent, of all withdrawals for
the 12 months ending with March
31, 1940. Manufacturers will pool
all leaf stocks in excess of their
average supply, and these will be
available to manufacturers with
less than average supplies. The
government, in turn, will under
take to secure from abroad such
additional supplies as are needed
and will prevent undue specula
tion in leaf.
Machinery for enforcing the
tobacco controls presumably will
be worked out by the controller
and a committee representing the
manufacturers. Final agreements,
although "voluntary" on the part
of the manufacturers, will be le
gally binding, according to re
ports to the U. S. Department of
Agriculture's foreign agriculture
office.
