That on the day of' April, 1920,
a summons in the above - entitled ac
tion was Issued against the "said de
fendants and others, by the Clerk of
the Superior Court for Polk County,
North Carolina, for the purpose of
setting aside certain deeds to the said
defendants, John P. Moore,, Beatrice
Moore and Moses Dwight -Mclntyre,
from Joe Moore and wife, Miranda
Moore, on the grund that said deeds
were executed through fraud, -duress,
undue influence, and for the further
purpose of compelling-the said Joe
Moore and' wife, Miranda Moore to
convey said lands to the said plain
tiff, which lands" are described as
being a part of Patent No. 1013 on
the waters of Mill Creek in Polk
County and being the same land con
veyed to . Joe Moore by deed dated
February 5th, 1906 and recorded in
Book 26, page 468 in the office ? of
Register of Deeds of Polk County.
' The above named defendants will
further take jiotice that they are re
quired to appear at the next term of
the Superior- Court of Polk County,
which will be held on the second Mon
day after the first Monday in Septem
ber, 1920, when and where the de
fendants are required to appear and
answer or demur - to tne complaint
which will be filed in the office of the
Clerk of the Court of said County,
or the relief demanded will be granted.-
