The arrest was made after the phy
sician who is a member of the stafl
at Oteen Hospital had filed complaini
against the superintendent for $50,
000. charging alienation of his wife's
affections.
Dr. Murphy was taken into custodj
as he sat at his desk in the count]
court house annex.
The complaint follows:
"That on or about the 9th day o:
August, 1924, in the city of Dubuque
state of Iowa, plaintiff intermarried
with Elinora Hernia Griffiths sines
named and known as Elinora Griffiths
Mandelos, and at the times of th<
commissions of the wrongs hereinaf
ter mentioned, the plaintiff, and hii
wife lived together as man and wife
and they have been living together ai
man and wife in the County of Bun
combe, North Carolina, since Octobe:
19M.
"That for a period of more thai
one year, or until about the first o
January, 1926, the plaintiff was livinj
and co-habiting with and supportin;
the said Elinora Griffiths Mandelos
having lived for several months a

North Carolina, and they were livinj
together hapily as man and wife; an<
at said time the defendant well know
ing the said Elinora Griffiths Mande
los to be the wife of the plaintiff
wrongfully contrived and maliciously
and wickedly intended to injure th<
plaintiff, and wrongfully deprive hin
of the affection, comfort, society an<
aid of his wife, and maliciously plan
ned and undertook to alienate the at
fections of plaintiff's wife and to ac
complish his purpose, acquired ar
improper influence over her.

schools of Buncombe county for sev
eral monts, namely: the Johnstor
school; that the said Elinora Griffith!
Mandelos was a young woman, being
about twenty-one years of age at the
time she began her present schoo'
year, being many years younger thai

ant used te power and influence o
his office, his maturity and expert
ence, to entice and ensnare the saic

easily available to him in his positioi
of power and influence as head of th<

to procure control of the said Elinor;
Griffiths Mandelos, to win the affec

The whole matter is a frame up ac3
cording to the statement and was ent
giueered by her husband who attempt
T ed to get her to join him in the suit
f against the county superintendent of
. schools and divide the money obtain,
ed after the suit was settled.
3 Mrs. Mandelos statement as it ap.
peaed in the evening paper of Wedr
tnesday follows:
"The charges made by Dr. Mandelos
against Dr. Murphy are false and
defamatory. There have ipaver been
any improper relations between me
and Dr. Murphy and the allegation
i made by my husband and published
; in the afternoon papers are absolute,
!y untrue and without any foundation
i in fact. I am not willing to sell -my
- soul for a mess of pottage; I am hot
- willing for my husband to destroy
J my reputation in order to further the
j interests of certain politicians.

promises to resume his marital re- j
lations after the trial is over, and to
divide the ill gotten spoils with me.
My conscience will not allow me to
be a party to such a corrupt bargain.
My honor is worth more than
money. I will fight for honor.
School Board to Hold Headng
A special session of the county
school board is announced for Tuesday
morning, April 6th at 11 o'clock
for the special purpose of investigating
the charges against the county
Superintendent. This session of the
county board of education will be an
open session according to the chairman
of the board. The parties involved
may if they desire have counsel
to represent them. It is more than
likely that this special meeting will
be held in the office of the superintendent
it is stated.
A special called meeting of the
school board was held last Tuesday
evening at which time the date tot
the special hearing was set.
In a statement to the members of
the board of education at the special
meeting Tuesday Dr. Murphy declare
ed that he was ready and willing to
step aside at any time, adding that
he had no wish to stand in the way

While no action retaining the superintendent
temporarily "wSs "taken at
the meeting it was decided that the
matter would not be taken up until
the meeting Tuesday when a tohrough
probe of the question is expected.
Those who have) followed developments
in the case recall that at the
time Dr. Murphy was brought here
last year there was considerable dissatisfaction
with the choice of the
board. However, there lias been nothing
to indicate that there is any connection
between the present case and I
the affair last spring other than that
