The recommendations and ac tions of the Commercial Fisheries Committee were accepted by the board. Hugh M. Morton, Wilmington, re ported that the Advertising Com mittee recommended the adoption of a $170,000 budget for state ad vertising. The committee also rec ommended that Bennett Advertis ing Agency, High Point, handle the advertising account. Mr. Morton pointed out that North Carolina has been getting bad publicity in the past on polio cases. He stated that the commit tee recommended that the tour ists be advised that North Caro lina is currently forty-fifth in num ber of polio cases in the nation. He said there were 13.5 cases of polio per 100,000 persons in North Carolina. Amos R. Kerns, ohairman of the parks committee, recommended that the board accept a proposal to grant $100,000 to the Tryon Palace committee. The palace com mittee is to use the money for the purchase of additional land for the restoring of Tryon Palace, New Bern. The parks committee decided to defer action on leasing additional j land at the Kerr Reservoir pro ject until members of the board I could go to the project and see the land proposed for lease from the U. S. government. Miles J. Smith, Salisbury, chair man of the Water Resources, In lets and Coastal Waterways com mittee, recommended that the board hire a chief engineer to im prove waterways, flood-control, and coastal areas. The board accepted the recom mendation. Before the meeting adjourned, Governor Umstead said, "I am very proud of what this board has done and I am proud of the men on the board. The suit, in which the racing as sociation asked $300,000 damages each season it cannot operate under its franchise, followed a State Supreme Court ruling that parl-mutuel betting is unconstitu tional in North Carolina. The racing association contended the state court's decision denied constitutional rights and it asked Judge Gilliam to restrain public officials from prosecuting bettors until the current case is tried in court. Moyock's track along with the track at Morehead City, was closed on a state order after both had been declared public nuisances. Operators of the Morehead City track decided not to open after the Moyock ruling and later were restrained under a permanent in junction signed by Judge Williams. In a new move, the Morehead City track operators sought to have Judge Williams stay execution of his injunction until such time the State Supreme Court could review the case. Then the operators ap pealed to Judge Gilliam. The Carolina-Virginia Racing As sociation has appealed to the State Supreme Court the decision by Su perior Court Judge Malcolm C. Paul which ordered the sale of the land on which the greyhound track at Currituck is located. The land hrs already been sold, for $8,000. The purchaser was the racing association. In the appeal tlje association con tended that sale of the track site should have been delayed. The Carolina Racing Aaaociation has appealed to the State Supreme Court the ruling padlocking the track at Morehead City. As a basis for the appeal, the track operators claimed Judge Clawson Williams erred June 8 in seising the property, in which more than 1300,000 had been in vested becauae he impaired the ob ligationa of a contract between a public agency? the Morehead City Racing Commission ? and the Caro lina Racing Aaaociation. Further, the operators alleged their constitutional rights were vi olated becauae they were deprived of their property without "due proceaa of law" and denied equal protection of the law aa guaran teed by the 14th Amendment. Arguments will be heard by the State Supreme Court at its fall term in September.
