Cherokee County Recorder's Court MURPHY ?The Cherokee County Recorder's Court met in regular session Monday, J uly 27, with his Honor C.E. Hyde present and presiding and Hooorahle F.O. Christo pher, Solicitor, present and prosecuting. The following cases ap peared at this session of courtt Jerry Ware, speeding: De defendant pleads guilty to speeding 55 mph in 20 mph zone. Prison sentence of 3 months suspended for two years on conditions and pay a fine of $100. Glenn Reece, speeding; fail ing to yield right of way: De fendant pleads not guilty to charge of speeding but guilty to the charge of failing to yield right of way; Court finds defendant guilty of driving at a speed in excess of that reasonable and proper under the conditions then and there existing. It is the judgement of the court that the defend ant pay a fine of $25.00 and cost in both cases. Anthony Dietz, N. O. L: The defendant plead guilty. Judgement of the court that defendant pay a fine of $25.00 and cost of the action. Haroldene Givens, speed ing: Warrant amended to charge of following too closely driving on wrong side of road and speeding at rate of 62 1/2 mph in 55 zone. Defendant pleads not guilty. Court finds defendant guilty as charged. Fined $25.00 and cost of the action. Jerry Green, assault: De fendant pleads not guklty; Court finds defendant guilty as charged. It is the judge ment of the court that de fendant be imprisoned in the county jail for twelve months and assigned to work under supervision of the State Prison Department. Jerry Green, V.P.L.: De fendant pleads nolo con tendere. Judgement of court that defendant be imprisoned for six months with sentence suspended for five years on conditions. Lyonel McHan: Solicitor states to court that he does not have sufficient evidence to convict the defendant and desires to move that the case be nos prossed with leave. Lewis Ogle: Warrant amen ded to charge of disposing of mortgaged property. The motion is allowed. Defendant pleads guilty to charge. It appearing that mortgage debt has been paid by defendant, it is ordered that the defendant be discharged on payment of costs. i Lewis Ogle: The defend*!* requests the court that he be allowed to withdraw his appeal from the 90 day sentence im posed in this case. Permission is granted and committment will issue to place prison sen tence into effect. Jimmy McClure: After con sultation with Solicitor and by permission of Judge W.K. Mc Clean, the defendant is per mitted to withdraw appeal to Superior Court and make his payments on five and cost in payments of $50.00 per month. Young Baines, Final Dis charge: It appearing that the defendant was placed on pro bation by Honorable Herman Edwards on 10th day of July, 1961, for three years and it further appearing that 3 years probation period has ended, it is ordered and adjudged that defendant be released and dis charged from the probation judgement in this case. Court adjourns. At the August 10 session of Recorder's Court the fol lowing cases were heard: John Gregory, Defendant called and failed. Judgement nisi sci fa and capias. Roy Laney, Defendant pleads guilty to public drunk enness. It is the judgement of the court that defendant be imprisoned in the county jail of Cherokee County for a period of 30 days and assigned to do work under the super vision of the State Prison De partment and pay cost of the action. Prison is suspended for a period of one year on conditions. Lorene Derreberry, Reck less driving: The defendant pleads not guilty to the offense of reckless driving. After hearing the evidence thecourt finds defendant guilty as charged. It is the judgement of the court that the defend ant pay a fine of $50 and cost of the actioh. Bobby Wayne McClure, speeding: The defendant pleads guilty to driving at a speed in excess of that reason able and proper under the circumstances. It is the judge ment of the court that the cost first be paid out of the $35 dash bond on deposit in the hands of the clerk and that the balance of the $35 if any, be turned over to the school fund as a fine. Fred Reid, Jr.; The defend ant pleads guilty to operating a motor vehicle upon the public highways of this state without a valid drivers license. It is the judgement of the court that the cost first be paid from the $60 cash bond on deposit in t the hands of the clerk and that the balance be turned over to the school fund as a fine. Fred Reid, Jr.: It appearing to the court that this is a duplication and that this mat ter was taken care of under the number of 7016 it is ordered that this case be re moved from the calendar. James M. Reid: The defend ant pleads guilty to operating a motor vehicle upon the public highways of this sute without a valid drivers license. It is the judgement of the court that the cost first be paidfrom the $65 cash bond in the hands of the clerk and that the balance of the $65 be turned over to the school fund as a fine as provided by law. Herman Nelson:This matter is continued on motion ofL.L. Mason, counsel for the defend ant until the 31st day of August 1964. Virgil Laney: Defendant pleads guilty to operating a motor vehicle upon the public highways of the State of North Carolina while in an intoxi cated condition, second of fense: It is the judgement of the court that the defendant be imprisoned in a county jail of Cherokee County for a period of twelve months and assigned to do work under the supervision of the State Prison Department and pay a fine of )250 and cost. The prison sen tence is suspended on con ditions. John Graham, Assault: The defendant pleads not guilty to the offense of assault on a female, he being a male over the age of 18 years. After hearing the evidence the court finds the defendant guilty as charged. It is the judgement of the court that the defendant be imprisoned in a county jail of Cherokee County for a period of nine months and as signed to do work under the supervision of the State Prison Department. Garland Frankum: The de fendant pleads guilty to the offense of unlawful possession of intoxicating liquors and not guilty to the offense of pos session of intoxicating liquors for the purpose of sale. After hearing the evidence the court finds die defendant not guilty on the charge of possession for the purpose of sale. On the court of unlawful poss ession of intoxicating liquors it is the judgement of the court that the defendant be im prisoned in a County jail of Cherokee County for a period of twelve months and assigned to do work under the Super vision of the State Prison De partment. The defendant gives notice in open court ot appeal to the Superior Court. Bond is fixed in the sum of (1,000. Bobby Docker y, Assault: The prosecuting witness hav ing been called and failed to appear it is ordered that a fine of $60.00 be entered against her. Donald Patterson: Thepro secuting witness having been called and failed to appear a fine of $50.00 is ordered against her. It is furtner ordered in 7012 that capias be issued for the defendant and that her bond be fixed in the amount of $20 for appear ance here next Monday morn ing.
