POLICY OF THE BRUNSWICK COUNTY PLANNING BOARD REGARDING APPLICANT REPRESENTATION BEFORE THE BOARD The Brunswick County Planning Board, in regular session, duly assembled, hereby enacts the following policy. 1. At the meeting between the Planning Director and the applicant, the Planning Director and the applicant simli ?v?k in munlvp nil mipstions and concerns relating to the administrative and/or substantive conformity of the applicants documents and/or materials then pending before the Brunswick County Planning Board as they related to conformity with the provisions of the Brunswick County 2. At the conclusion of the meeting between the Planning Director and applicant, If it is the opinion of the Planning Director that significant conformity problems exist in regards to the administrative or substantive conformity of the applicant's documents or materials with the provision of the Brunswick County Subdivision Ordinance, the Planning Director shall send to the applicant a letter setting forth the position of the Planning Director and requiring the applicant or duly authorized agent thereof to appear before the Brunswick County Planning Board at its next meeting. Said letter shall contain the directive that the individual so appearing on behalf of the applicant must have the authority to niiiki' hindinu sljitrmi-nK nnd di?ri sions relating io aii nuiiicrs of subdivision amendment und definition. The letter must nlsn contain n statement as to the location, date and time of the PlonnlnK Board meeting to which attendance Is required. SM?} U (919 9C-6A88 Navassa Mai For Indecent BY TERRY FOFE A 27-year-old Navassa man was given a six-month active prison sentence last week for taking indecent liberties with his 14-year-old girlfriend who later became pregnant. Ivory Ballard was sentenced Thursday after pleading guilty in Brunswick County Superior Court. Although Assistant District Attorney Napoleon Barefoot Jr. was prepared to prosecute the case, Ballard entered a guilty plea on his own, thus avoiding a trial. Judge B. Craig Ellis sentenced Ballard to three years in prison, suspended for five years and placed the defendant under five years' supervised probation. Taking indecent liberties is a felony that carries a maximum sentence of ten vears in prison. Under special conditions of his probation, Judge Ellis also ordered Ballard to begin serving immediately a six-month active sentence in the N.C. Department of Corrections in Raleigh and to pay the victim $150 in restitutions. Ballard was also ordered to undergo evaluation for alcohol abuse and to seek treatment as recommended by the department of corrections. According to Barefoot, the victim spent $150 after Ballard's arrest tn pay for an abortion. After the 14-year-old girl became pregnant, Ballard turned himself in at the Brunswick County Sheriffs Department on July 15, 1984 where Detective Lindsay Walton charged the suspect with rape. N.C 2MG 919 n Sentenced Liberties At a preliminary hearing in Brunswick County District Criminal Court, probable cause was found on charges of taking indecent liberties with a minor instead. In court Thursday, Ellis ordered Ballard to avoid contart with thp tim for five years unless he has written permission from the girl's parents, and to not go about her school or place of work during the probationary period. According to Barefoot, the two had known each other for a couple uf weeks before they had sexual relations in the woods near the Navassa ball park. At the time, Ballard did net know the girl was only 14 years old, evidence that was iirst introduced at the probable cause hearing in July. According to Michael Isenberg, Ballard's court appointed attorney. Ballard has spent 32 days at an alcohol rehabilitation center in Greenville since his arrest. He also served seven days in the Brunswick County Jail betore being released under bond. "He is taking steps to overcome this addiction (alcohol)," Isenberg told the judge. "We believe this had some effect on what happened the night that it happened. He should have been more careful about who he was with, but he honestly did not know her age." In sentencing Ballard, Judge Ellis told the defendant that under North Carolina law, someone under the age of 16 is not able to give legal consent to have sexual relations with another person. ?rnp!oyment t Month Brunswick County fell in February, from 12.4 percent to 11.2 percent, figures from the N.C. Employment Security Commission reveal. According to the report, in February there were 2,240 unemployed persons in Brunswick County compared to 2,470 in JanuaryBrunswick County's unemployment rate is still significantly higher than the state average of 6.7 percent. "As the coming months bring warmer weather to the state and a return of the agricultural and tourist season," Campbell added, "our analysts expect the high unemployment we're presently experiencing in the eastern and western regions to abate." Unemployment rates also decreased in several surrounding counties in February. In Columbus County, the rate fell from 12.8 percent to 11.4 percent and from 8.3 percent to 7.3 percent in New Hanover County. Bladen County experienced the least change, from 12.7 percent to 12.6 percent. Orange and Durham counties lead the state with rates of 2.5 and 2.9 percent.
