Officials from seven North Carolina counties and one South Carolina County were involved in the Other drills are held at one year intervals, but those only involve Brunswick and New Hanover counties. Cecil Logan, county emergency management coordinator, said ed In Lawsuits Dismissals Further, the answers alleged that if the defendant were in any way negligent that "plaintiffs were guilty of contributory' negligence in that if they saw damage occurring to their property they were under a duty to protect such property and failed to do so." The company lias requested the cases be dismissed; otherwise it seeks jury trials. The answers also contend that plaintiffs' property "was in poor condition that was unknown to the defendant at the lime it was doing this work, and due to the age and poor condition of the property it might have suffered some minor and slight damage during the period work was being done in the vicinity." "If there was any damage it was mainly due to the age of the building and was easily correctable. In any event, any damage done was not due to any negligence or wrongdoing of this defendant," according to the answers. Also, the responses claim the construction firm "relied on the knowledge, expertise and protection of the N.C. Department of Transportation in doing the work it was told to do." and that it "performed its work in the normal, customary and proper manner and liad no knowledge or forewarning that any damage might result."
