SEWER SYSTEM BEING STUDIED Owner To Improve Cowgirls Building BY DOUG RUTTF.R Ocean Isle Beach officials have worked out an agreement with the owner of a local nightclub building that was ordered to shut down earlier this year due to state building code violations. Meanwhile, Brunswick County health offi cials are investigating the club's sewage system to see if it is adequate and functioning properly. Ocean Isle Beach Building Inspector Druied Roberson said the owner of the Cowgirls build ing on N.C. 179 has agreed to make several changes to bring the structure into compliancc with the state building code. Improvements include the addition of a sprin kler system, an exit and lighted exit signs. The owner also has agreed to run a conduit to an out door flashing light and have the balcony inspected. Roberson said the proposed changes probably will be made in stages, but a timetable for the im provements had not been developed as of Tuesday. The agreement was worked out during a meeting Tuesday afternoon with Town Attorney Elva Jess and Michael Ramos, attorney for the owner of the building. Betty Gore owns the building, and Vicky Coleman leases the building and owns the busi ness. Roberson ordered the club vacated and shut down earlier this year after ruling that it was op erating in violation of the North Carolina Building Code. Slate code doesn't allow more than 100 peo ple on the second door of a wood-frame con struction building. It also prohibits establish ments that serve food or drinks that also have dancing or offer entertainment to locate on the second level of those types of buildings. Roberson said the improvements to the build ing would take care of those violations and allow the club to continue operating. John Crowdcr, environmental health supervi sor with the Brunswick County Health Department, said the department is investigating the sewage system that serves the nightclub to de termine if it is adequate. County health officials are studying the size of the system and water usage to see if the sys tem is being overloaded. Crowder said the coun ty should have some answers by next week. The department has received about a half dozen complaints from nearby residents who say the sewage system at Cowgirls is discharging in to a ditch behind the building. Crowder said a concentrated red dye was added to the system about two weeks ago and there has been no evidence of it in the ditch or anywhere else outside of the system. Slick Highways Cause Slippery highways caused a rash of minor traffic accidents last Fri day, but no serious injuries were re ported by the N.C. Highway Patrol office in Wilmington. In one accident on U.S. 17, a Shal lotte man received minor injuries af ter his pickup truck struck the rear of another car around 4: 1 5 p.m. William Donald Carter Jr., 30, was charged with failure to decrease speed by State Trooper R.L. Murray. According to Murray's report, Carter's 1983 Nissan was traveling south on U.S. 17 when a vehicle in front of his truck slowed for traffic at the intersection of Mt. Pisgah Church Road (RPR 1130), about 4.1 miles north of Shalloue. Carter's truck hit the right rear of a 1984 Toyota driven by Robert Lawrence Stanley, 32, of Shallotte. Stanley was not injured. Damage was estimated at 51,000 to the Carter truck and S500 to the Stanley vehicle. Another accident Friday sent a Supply woman to the hospital with minor injuries. Rash Of Minor Wrecks was injured after her 1985 Ply mouth struck the rear of another ve hicle on N.C. 130 about 2.3 miles west of Holden Beach. According to Stale Trooper B.L. Wilkes, Ms. Arrowood was charged with failure to decrease speed after her car struck the rear of a 1986 Jeep driven by Wendy Phelps Evans, 20, of Supply. Wilkes reported that both drivers were traveling west on N.C. 130 when the Evans car slowed due to traffic. After the collision, Ms. Evans vehicle then traveled off the left side of the road. Damage was listed at S500 to the Arrowood vehicle and SI, 000 to the Evans vehicle. Ms. Arrowood was taken to The Brunswick Hospital in Supply fol lowing the 6:10 p.m. accident. Former Local Restaurateur Accused Of Sales Tax Evasion A Rockingham businessman with Brunswick County tics has been ar rested and charged by the N.C. De partment of Revenue with attempt ing to evade or defeat state and county sales taxes. W.R. Tyler, 58, of Brookbank Road, was charged with 25 counts of attempting to evade or defeat North Carolina and Richmond County sales taxes. Tyler is president of Riverside Development Corporation of Shal lotte, which operates Munchi's Sea food Restaurant in Rockingham and formerly owned and operated a Munchi's restaurant in Shalloue that closed in the mid-1980s, said Phil Bridges, public information officer with the N.C. Dept. of Revenue. The warrants against Tyler allege that while operating the restaurant in Rockingham from June 1988 through October 1990, he devised a scheme to understate his taxable sale on North Carolina sales and use tax reports. Tyler appeared before a Rich mond County magistrate on May 22 and was released after posting a 52,500 unsecured bond. The charges against him came as the result of an investigation by a field auditor in the Dept. of Reven ue's Rockingham office and a spe cial agent with the agency's Special Investigation Section in Raleigh. Tyler's first court appearance is scheduled for June 27 in Wake County District Court in Raleigh. If convicted of the charges agai nst him, Tyler could face up to 75 years in prison and fines of up to S250.000.
