Supply Man Pleads No Contest In Memorinl Dnv Playground Shooting a ^/-year-oia Supply man was sentenced to a year in prison last week after pleading no contest to charges alleging that he opened fire with an assault pistol on four men Playing basketball in a crowded In Brunswick County District Court Monday (Aug. 23) the defen dant, Nathan McMillan Jr., pleaded no contest to four counts of assault by pointing a gun. He then appealed the convictions to Superior Court. A charge of communicating threats was voluntarily dismissed bv the prosecutor. M Ma nan,LWCrf 'akcn out ;,8''ins. McMillan May 3(1 by four men who said he fired a 9mm lech -9 semiau tomatic assault pistol at them after a dispute over a basketball game at the public park in Supply. A rech-9 is a cheap copy of an automatic machine pistol used by military and police organizations. One of the men who swore out warrants, David Johnson of Dur ham, told the Beacon that he and three others were playing basketball when McMillian approached and asked if he could join. Johnson said they agreed to let him play in the next game. Johnson said McMillan left the area for a while, then returned and got into an argument after being told that he had missed his turn to play. McMillan left the park again and al legedly came back carrying the pis tol and a shotgun. McMillan allegedly fired about seven shots from the Tech-9, send ing the basketball players and others running into the woods. Johnson said. He estimated that there were about 50 or 60 people at the park including about 30 children. After accepting the plea of no contest, Judge Napoleon Barefoot gave McMillan a six-month sen tence on one conviction and another six months for the three other charges. The sentences are to run consecutively. The judge ordered McMillan to stay away from the prosecuting wit nesses while awaiting his Superior Court trial, but made no adjustment to the $500 unsecured bond set by the magistrate after McMillan's ar rest. Last month, McMillan was arrest ed on charges of attempted murder and breaking and entering for al legedly shooting an ex-girlfriend four times with a .25-caliber pistol. Those charges are pending in Superior Court. . . . Judge Barefoot presided over three days of district court last week with Assistant District Attorney Rick Green offering evidence for the state and Marie Jordan serving as court clerk. Other defendants who appeared in court last week, with their charges, pleas and judgments include: Chris Alston, first degree tres passing, prayer for judgment contin ued and costs remitted, not go on property of plaintiff. Department of Corrections one year, suspended sentence two years, $200 and costs, Brunswick County Jail eight days 9-19 to 9-23 6 p.m., assessment within 60 days to Samp son County, submit to test, surrender license. Patrick Barry, simple worthless check to Wilson for $20, Brunswick County Jail 30 days, suspended sen tence two years, $20 restitution, $15 service restitution charge, costs, not issue any worthless check for two years, not violate any laws for two years.
