Victim Jailed After Refusing To Testify Against Assailant Lying in a hospital bed last July, I.isa Ann King told police she had been shot four times by Nathan McMillan and was saved from a fa tal fifth shot when the gun misfired. On the witness stand in Bruns wick County Superior Court last week. King refused to testify against her attacker and was thrown in jail for contempt of court. Without her testimony, the jury was unable to find the 27-year-old Supply man guilty as charged of at tempted murder and breaking and entering. Instead. McMillan was convicted of assault with a deadly weapon and sentenced to nine years in prison. "I have my suspicions, but I'm not at liberty to speculate." Assistant District Attorney Lee Bollinger said when asked about the possible rea sons for King's refusal to testify. McMillan surrendered to police after the 33-year-old Shaliotte wo man identified him as the man who shot her four times with a .25-cal iber pistol on the night of July 14. King was hospitalized with bullet wounds to the face, the left hand, the left ring finger and the left hip. According to a statement she al legedly made to Brunswick County Sheriff's Detective John Ingram. McMillan and King had been living together until shortly before the shooting. McMillan spotted King on Mulberry Street that night and stop ped by her house to talk. The two got into an argument and McMillan allegedly pulled a gun and started firing King was hit three times as she ran into her house, locked the door and hid in the bed room, Ingram said. McMillan broke in through the back door and strug gled with King, who fell to the floor. "He shot her once in the face. Then he pulled the trigger again and the gun clicked," Ingram said after taking a statement from King at the hospital. A written statement corroborating that account and signed by King was marked as a state's exhibit in the court file. But during the trial Tuesday. King refused to testify about the state ment's validity and was found "in direct contempt of court" by Judge J. Freeman Britt. She was released Wednesday at the close of the trial. McMillan's nine-year prison term will begin at the expiration of a one year sentence he received last month after allegedly firing an assault pis tol at four men playing basketball at a crowded playground on Memorial Day Weekend. In that case, McMil lan pleaded no contest to four counts of assault bv pointing a gun. Judge Britt presided over three days of Superior Court last week. Assistant district attorneys Bollinger and Rick Green offered evidence for the state. Lisa Aycock served as courtroom clerk. In other Superior Court action last week: ?l-redcrick Allen Evans Jr.. 19, of Wesley Trails, Supply, was sentenced to 13 years in prison after pleading guilty to two charges of felonious breaking and entering and five counts of larceny. An additional five-year sentence was suspended on the con dition that he pay restitution and court costs and that he testify against his co-defendants if called upon to do so. After his release, Evans will be put on five years probation. ?Douglas Marion Malpass, 26, of Wilm. was sentenced to seven years in prison alter pleading guilty to one count each of breaking and entering, larceny, first-degree trespassing and attempted larceny. If allowed out on parole or work release, he is to pay court costs and $300 attorney fees. ?Matthew Joseph Richard, 20. of Starboard Road, Shallotte. was sen tenced to two years after pleading guilty to misdemeanor larceny and admitting that he had violated the terms of probation in an earlier con viction. If allowed out on parole or work release, Richard is to pay $250 for his court appointed lawyer. ?Johnny Paul Hedwin, 22, of Clarendon was sentenced to three years in prison after pleading guilty to one count of receiving stolen property. The sentence is to begin at the expiration of any sentence he is now serving. He had been charged with breaking and entering and lar ceny of a firearm, but was allowed to plead guilty to a lesser offense as part of a plea bargain. He was or dered to pay court costs and $ 1 50 in attorney fees. ?Johnny Long, 32, of Whiteville was sentenced to two years in prison after pleading guilty to breaking and entering and larceny. He was or dered to pay court costs and S3CH) in attorney fees. ?Bruce Timothy Blake, 30, of the Captain's Cove Motel, Long Beach, was sentenced to 90 days in the Brunswick County Jail after plead ing guilty to one count each of breaking and entering and larceny. He was also given a 10-year prison sentence, suspended on the condi tion that he pay court costs, restitu tion and S250 in attorney fees. He was put on five years probation and ordered to testify truthfully against his co-defendants in the case. PUBLIC NOTICE The Brunswick County Board of Commissioners shall conduct a public hearing on proposed amendments to the Brunswick County Zoning Ordinance and Partial Development Code on December 6, 1993 at 6:00 P.M. in the Commissioners' Chamber, Administration Building, Government Center, Bolivia, NC. (5) No infrastructure demands shall be generated by the Home Occupation in greater volumes that would normally be expected with a residential use. (6) Instruction in music, dance and similar subjects shall be lim ited to two students at a time. SECTION B Section 4.103. R-6000. Medium Density Residential.
