County Ordinance

What kind of noise annoys a
neighbor?
That's a question people will have
to begin asking themselves if the
county commissioners pass a draft
noise ordinance scheduled for a pub
lic hearing next month.
After frequent requests trom the
public at commissioners' meetings,
the proposed law was presented to
the board by County Attorney
Michael Ramos Monday night. It
defines an illegal noise as one that
would be considered loud or disturb
ing by an "objective, detached, rea
sonable person."
Among the noise generating ac
tivities specifically prohibited by the
law arc the use of construction ma
chinery, chain saws or garage ma
chinery between the hours of 9 p.m.
and 7 a.m. The use of lawn mowers
and other "domestic tools" would be
outlawed between 9:30 p.m. and
6:30 a.m.
The law would prohibit any per
son from keeping a dog, bird or oth
er animal "which, by frequent or ha
bitual howling, yelping, barking or
otherwise, causes loud noises and
produces seriously annoying distur
bance to any person or to the neigh
borhood."
It will also be unlawful under the
ordinance to yell, shout, whistle,
sing, play musical instruments or
any sound-magnifying device such
as a radio, television, stereo or tape
deck "with such volume as to rea
sonably annoy or disturb the quiet,
comfort oi repose of a person."
Organizers of events that require
electronic sound amplification
would be required to obtain a permit
from the sheriff's department. The
one-time permit would allow "tem
porary unreasonable noise incident
to legitimate activities including the
full rights of freedom of speech."
Those activities might include reli
gious gatherings, political rallies and
concerts.
Also prohibited under the pro
posed law is the operation of any mo
tor vehicle or motor "that has had its
snuffler sxhsus! unti/cr other nciiic
control equipment removed, altered
or maintained in such disrepair as to
create loud and disturbing noises."
Landlords would be responsible
and liable under the law for the ac
tions of tenants. The property owner
would be sent a letter by the sheriff
or county attorney notifying him of
any violations by tenants. After noti
fication, the landlord could face civil
penalties if the disturbances persist.
Violations of the proposed law
could be enforced in any of three
ways. The offender could be issued
a citation and ordered to pay a civil
penalty of $50. A civil action seek
ing an injunction could be directed
toward the offender or landlord. Or a
misdemeanor warrant could be is
sued.
Two people appeared at Mon
day's meeting to ask the commis
sioners to adopt a noise ordinance.
The board made no comment on
the draft law Monday r.ight. A pub
lic hearing was scheduled for April
18 at 5:30 p.m. in the public assem
bly building at the county complex.
In other business the board:
?Tabled the award of an architectur
al contract for designing improve
ments to county government build
ings required under the Americans
with Disabilities Act. A committee
of County Engineer Robert Tucker
and County Manager Wyman Yelton
studied proposals and heard presen
tations from numerous firms and
recommended that the board accept
a $49,000 bid from Wilmington
Architect John Sawyer. Commis
sioner Wayland Vereen and Donald
Shaw asked to delay the award to
see if a Brunswick County firm
could be found to do the work.
?Heard a presentation by Lloyd
Ward, president of the Brunswick
County Commercial Fisherman's
Association, describing the growing
pressures on the local seafood indus
try caused by pollution and govern
mental regulation. The board agreed
to appoint a committee to meet with
fisherman in an effort to address
their concerns.
?Agreed to ransfcr $48,000 from
the county administration budget to
the landfill budget for a major over
haul of the Southport solid waste
transfer station. County Engineer
Robert Tucker told the board that
the steel structure of the facility "is
rotted away with rust to the point
that there's not enough materia! in
place to weld."
?Authorized Health Director Mic
hael Rhodes to upgrade a communi
ty health assistant position from half
infrpoml
caseload in the Women, Infants and
Children (WIC) nutrition program.
All funds for the position are provid
ed by the state.
?Approved Public Housing Director
Thurman Everett's request to reorga
nize his department and hire an ad
ditional worker to administer the
federally mandated Housing and
Urban Development Family Self
Sufficiency Program. Everett told
the board that the change was feder
ally funded and would not require an
increase in county spending.
?Signed a contract to lease the for
mer Iceland Library building to the
Iceland Dixie Youth Baseball organi
zation for one dollar a year. The
group has agreed to make the build
ing available for use by other civic
organizations.
?Adopted resolutions supporting the
establishment of a first-class U.S.
Postal Service office on Oak Island
and the construction of a second
bridge to connect it with the main
land.
?Voted 3-to-2. with Commissioner
Jerry Jones and Shaw dissenting, to
appoint Johnny Vereen III to rcplacc
William Fairley on the Bruns. County
Airport Commission. The dissenting
members voted for John Ramsey.
?Reappointed Hannon Templeton
Jr. to the board of equalization and
review and Bob Crocker to the rep
resent the Calabash extra territorial
jurisdiction on the town's board of
adjustment.
