Burger was a third-year probation ary tcachcr not previously eligible for a long-term contract or tenure Filed by Richard A. Schwartz and Associates in late August on behalf of the school board and co-defen dant Superintendent Ralph J. Johns ton, the defense's response asserts that Burger's claims under the Americans With Disabilities Act should be heard in charges filed with the Equal Employment Opportunity Commission. It states neither the school board nor Johnston have been named as respondents in any charge filed with EEOC and no right to sue letter has been obtained as required by inc act. Further, it contends defendant John ston is not an "employer" within the meaning of the act. It asks that the petition for review be denied and that Burger be re quired to pay the school system's cost of defending her action. Burger asserts all absences taken during the school year were protected under the Americans with Disabilities Act and Family and Medical Leave Actj which the school board denies. In hcf request for judicial review Burger has asked the court to award doable damages, reinstatement to her post as a vocational education teacher or its equivalent, and tenure. Burger asserts all absences taken during the school year were protect ed under the Americans with Dis abilities Act and Family and Med ical Ixavc Act. which the school board denies. In addition to family leave she al so qualified for short-term disability benefits after suffering "acute pho bic anxiety and depression" that al legedly impaired her ability to teach, tier request under the ADA for transfer to another school as a "rea sonable accommodation" of her dis ability was denied. On the recommendation of Prin cipal Rick Lawson and Johnston, the school board voted May 27 not to renew the probationary teacher's contract for the 1994-95 school year. In response to a request for a hear ing. Burger was advised in a June 17 that superior court was the appropri ate route of appeal, the response states. In addition, she was also asked to forward to the school board's coun sel "any 'serious information' re garding an illegal basis for the Brunswick County Board of Edu cation's decision," but has not done nity as a defense of Johnston, assert so. ing he acted in good faith in his role The response seeks official immu- as superintendent.
