Man Must Pay Funeral Expenses For Friend Hit By Propeller TWo Cumberland County men faced chargcs in Brunswick County District Court last week stemming from the death of a companion who was killed in a boating accident near Sunset Harbor last summer. David Kent Swiderski, 33, of Wade pleaded guilty to a charge of "operating a motorboat in a reckless or negligent manner so as to endan ger the life, limb or property of an other person." In a plea bargain, the prosecutors dismissed charges of manslaughter and operating a boat while under the influence of an impairing substance. The charges were filed against Swiderski after the death of 23-year old Johnny Hifter Gray of Fayctteville, who was hit by the pro peller of a 150-horsepower outboard motor on a boat Swiderski was dri ving on Aug. 8. According to N.C. Wildlife Offi cer Milton McLean, the two men and William Ray Murphy Jr., 20, of Hope Mills were taking turns water skiing at about 8 p.m. in the Intracoastal Waterway about a quar ter mile east of the Sunset Harbor Wildlife Resources Commission public boat ramp. It was Gray's turn to ski, McLean said after the incident. As the boat was circling to the left. Gray jumped into the water off the right side. The rear of the boat continued to swing until the propeller hit Gray in the stomach and chest area, causing fa tal injuries. McLean initially charged Swider ski with boating while impaired. After the incident was investigated further, additional charges were filed against Swiderski and Murphy, who was accused of being an accessory to manslaughter. The charge against Murphy was dismissed in court Wednesday at the request of the officer. After pleading guilty, Swiderski was sentenced to six months in jail, suspended on the condition that he pay $60 court costs and $500 toward Gray's funeral expenses. He was or dered not to operate a motor boat for two years and to obtain a psycholog ical assessment for possible alcohol abuse. Judge Jerry Jolly presided over four days of district court in Bolivia last week. Assistant district attor neys Marion Warren and Rick Green prosecuted, along with local attor neys Michael Ramos and Michael Isenberg. Marie Jordan served as courtroom clerk. Other defendants who appeared in court last week, with their charges and judgments include: Amy Akers, misdemeanor proba tion violation out-of-county, proba tion terminated. Lawrence Ament, misdemeanor larccny, voluntarily dismissed at the request of plaintiff. Joseph S. Blatcher, DWI, Level 5, Brunswick County Jail 60 days, sus pended sentence two years, $100 and costs, surrender license, assess ment, 24 hours of community ser vice within 30 days, pay fee, not vi olate any laws for two years. Lisa A. Champlin, speeding 64 in a 55 zone, costs; no operators li cense, voluntarily dismissed. Ivy Devon Cutrell Jr., expired registration card/tag, Brunswick County Jail 30 days, suspended sen tence two years, $25 and costs, not violate any laws for two years.
