THE SOUTH'S Leitei To Editoi I Mr. Martin Harmon, Editor I Kings Mountain Herald A Dear .Martin: * / I have noticed with consider able inlere.st and curiosity the re cent writings regarding bids on paving in the City of Kings Moun tain. I could not help but take the time to write you a letter concern ing the situation. From what you say, it appears hat the City of Kings Mountain has made substantial savings by awarding contracts to one con tractor on the ba-'« reported in our paper since 1965. ■* © Knowing all of the city coni- missioners and the mayor and Pat Spangler, I cannot honestly state lhal they have intended any de gree of malpractice involving city funds in bidding on pavement contracts. It may be. as you say, that their method of bidding has been beneficial to the city coffers. The problem, Martin, is the same that surrounds mo.st reasons for all of our laws, and that is that a few rotten apples require that all be protected by the law. If the law requires open bidding on these contracts, then that should be the case. These laws were made to protect the citizens from tliose that would allow malprac tice Of under the table dealings in a situation of this nature. I al- .so consider that these laws protect bot^ parties; for example, when governmental bodies operate the law they cannot be accusecHl or be tempted to operate undei^-^ Ihe (able and then the citizens, S"condly, receive the added bene fit of being protected by a law re(juiring open public bidding on such as street and curbing con tracts. What is unusually odd auout this situation is that com petition, especially in city con tracts, usually providi-s a better price than single awarding of contracts to one individual. I tiiink that you would agree that in most markets competition brings the price in line. It appears to me then from what lias been reported that the c'ty has saved a substantial amount of money by their method of bidding, but becau.se the city i.s operating on monies supplied by the citizens of Kings .Mountain it stands to reason that all bids should be held under the law to protect both the stockholders (tax payeis) and Ihe administrators (city government officials). Then tr«), you may want to u.se the an alogy of price versus risk. It may co.st the taxpayers of the City of Kings Mountain a higher price through comparative bid ding if we use your reporting as fact, but the risk is less. The risk, of course, being that if such as tins i.s allowed to be handled out side of the law no citizen really re.sts assured that there are not ither situations in the city go^»^ "inment being handled outside the law which may be costing them their very soul. As you know, Martin, I'm not any longer a resident of the City of kings Mountain, but I do have great feelings for the people Iheie. For this reason I have writ ten this letter to you personally IS I felt compelled, as I have many times in the past, to give you my opinion. In summation, then, I would say that if it is the law, let us follow it; if we do not like the law, lets change it ihrough the proper legal chan nels.
