Green was Judged guUty by a C3eveland Oounty Superior Court Jury last Friday following more than eight hours of deliberation. Judge Forrest FerreU sentenced Green to life Imprisonment on first degree rape and 40 years In prison on the second degree murder charge In the death of Mrs. Rosemary Kiauer, 48, of Daytona Beach, Fla. TTie rape-murder occured at the Kings Mountain Iim at the Intersec tion of 1-86 and Hwy. 161 on October 8,1076. Police determined die actual attack took place In a small wooded area behind the motel. The body was discovered on October 4, by Kings Mountain officers. Green, a Una, S. C. native, was enqilQyed by Mrs. Knauer at her penny arcade at the Cleveland Oounty Fair last October. The Jury retired on Thursday afternoon to deliberate, but no decision was reached by 10:16 p. m. that evening and the Jurors were sent home. The Jury began dellbera- tlons again at 10 a. m. Friday. The trial lasted four and a hall days during which testimony from 20 persons was heard, plus photographs of the victim and a tape recorded confession from Green being offered Into evidence. Judge Ferrell declared that Green’s 40-year sentence was to begin at the conclusion of the life sentence. In this case Green will spend a minimum of SO years In prison. Life Is considered 80 years and convicted prisoners must serve 26 percent of the sentence before being eligible for parole con- slderatlan. Kings Mountsdn Police Depart ment was In charge of the Investi gation and according to Chief Eso'l Lloyd, "It was a very difficult case to follow because of the proximity to the motel of the crime and the transient guests — suspects In volved.” The chief said 16-30 i^rson* registered at the motel on Sunday, but left the next morning the weekend of the rape-murder, had to be checked out. A lot of time was consumed by various agencies assisting because of the fictitious names used by a few registered guests at the motel. Chief Lloyd said he estimates 10,000 manhours were spent In the Investigation. That includes the Kings Mountain force, the Cleveland County Sheriff’s Department, the SBI, FBI, Law Enforcement Agency of S. C., U. S. Army personnel at Fort Bragg, the N. C. Attorney General’s office and the depart ments In Raleigh, Fayetteville, Myrtle Beach, S. C., New Toric City, Wheeling, W. Va. as well as agencies In Georgia, Florida, Louisiana and Nevada. Piedmont Ave. The Ander son car reportedly turned left Into the path of the yw at North Battleground and Gold Streets. Damaps were estimated at $460 to the Anderson car and $860 to the Bagwell vehicle. Charles S. Whaley, of Elizabeth City, operating a 1976 Olds, backing from a driveway Friday, struck,a 1969 Ford, traveling 3. on Gantt St., and operated by Glenda P. Aden of Pine Manor Apartments. Damages were estimated at $50 to the Whaley bumper and panel and $800 to the right rear lender of the Allen car. According to In vestigating Ptl. Bill Benton, a car operated by Carroll Eugene Keep, of Llncolnton, traveling south on 216, left the road at the railroad. Jumped the track and traveled 160 feet before coming to rest on the right side. The front and top of the vehicle was damaged approximately $2,000. Cars operated by Kevin A. Fields, of Rt. 8, Dallas, and Charles T. Etters of 208 Bridges St., hit Saturday. Fields, operating a 1970 Mercury, told Investigating Ptl. J. A. Burton that he didn’t see the Etters car traveling west on Llnwood Rd. and proceeded to come off Church St. Damages were Ware Lends Big Shark Frank Ware of Kings Mountain had a big day Ashing May 21 at South Port, N. C. Ware landed a six foot long, 200 pound shark while fishing on the Idle On II. estimated at $900 to both vehicles. Alice B. Lane, of 388 Stowe St., backing from a parking ^ace on West Gold St., struck a 1976 Yamaha motorcycle owned by Danny E. Spear man, of Rt. 2, according to Sgt. Bob Hayes. Damages to the Yamaha and car were estimated at $100 each, said KMPD.
