Suit Filed Against KM Some property owners at Moss Lake have filed a suit against the City of Kings Moun- tain charging that they have been denied free access to the lake. The suit alleges that the pro- perty owners are forbidden to use a strip of land between their properties and the lake unless each leases his section of the strip for $125 annually. The suit was filed on behalf of property owners by Buford and Wilda Cline. They sold their land to the city in 1971 for the purpose of flood control. Accor- ding to Cline, an agreement reached at that time between the Clines and the city s*ated that the Clines’ heirs aid assigns would retain acces, across the strip. The suit contends that all of the lake front lots they subse- quently sold retained those ac- cess rights. According to Cline, no trespassing signs have been posted along the flood zones and the Kings Mountain Lake Authority has sent letters to the owners warning those who have not paid the fee that they may face criminal charges if they cut the grass along the string or use any pier that may already be in place. The suit states that criminal charges have already been lodg- ed against two owners, Jerry N. Floyd and Sara M. Deberry, alleging violations of a city or- diance forbidding the mooring of boats to private facilities. However, the suit states, the ordinance does not require leas- ing of any area except for com- mercial facilities open tothe public. The Clines claim that attempts by the owners to pay a pier fee and other lake-related fees have been refused when not accom- panied by the $125 waterfront use fee. Kings Mountain tax- payers do not have to lease the land in front of their property. The suit charges the Lake Authority with enforcing regula- tions “in different ways at dif- ferent times” and asks the court to determine the rights of the Clines and other property Owners.
