The case picked up mo mentum in the Spring of 1956 when Mrs. Louise Las riier of Seaboard was refus al the privilege to register, flew through the 11. Os the 28,432 citizens of Nort hampton County. 68 per cent are non-white. In the face of this 1 high percentage, however, just a few hundred Negroes are regis tered. From ever since her hus band registered in 1950. Mrs, Lassiter determined to vote also. District Court, asking that consideration be giv en to the eliminnation of the lit eracy test as a means of deter j mining one’s eligibility to vote. But Just seven days before the court hearing, the North Ca.ro ; lina General Assembly weaken | ed the case by amending the i laws governing registration. In 1 Its legislation, the assembly set ' up a system of appeals from the i rulings of registrars, including ' appeal to the highest odurt in North Carolina. However, the literacy test was retained. The court later declar - ed Article VI. Section 4, of the | State Constitution void and vto ! lative of the Constitution of the United States: nevertheless, Mrs. Lassiter was instructed to 1 exhaust the appeal remedies set ■ up by the General Assembly. In her second attempt to register, June 1957, Mrs. Las siter refused to take the lit eracy test. Thereupon, the ' County Board of Elections. ' the Superior Court of Nort hampton County, and the State Supreme Court upheld the registrar’s derision to dss- I qualify her. Again she sought i| the Intervention ot the fed eral court. This time she em ployed Attorney James E. Walker. Mrs. Lassiter is by no means ; an illiterate She completed at least one year of high school i training. James R. Walker is the only Negro attorney in the six-coun ty area northeast North Caro lina. Bertie, Gates, Halifax. Nort hampton. Warren, and Hertford Counties. But Mrs. Lassiter did not hand him her case on that account. Walker is a firebrand, civil-rights attorney who is de dicated to his profession, be cause. said he, "i saw so many people without legal counsel or guidance of the type they want ed.” He recalls, "Negro. ,3 had to employ the boss’ lawyer when they needed counsel. The boss advanced the money and then deducted it at the aid of the year.” As a matter ca 2aot, At torney Walker’s observation is not mere recollection of some truth it is a present fact. As a civil-rtghts fighter, Mr. Walker has supported Negro political platforms in an effort to stim ulate registration and voting He is remembered for having manag ed the campaign putting up Dr. J. A. Tinsley, a physician, for mem bership on the Board of County Coimms.donei-3. Mrs. Lasiter was sure, therefore, that her case was in good hands. Walker’s first move was to look into the methods employed in ad ministering literacy tote. He ob served, among other things, that the registrar, a Mrs. Taylor, dls tated sections of the North Caro lina. Constitution so rapidly that the prospective registrants could not write down all tint she said. WaUrtar intervened, pointing out this fact to the registrar. He in sisted that many of the persons feeing total had diplomas from tastitattons attesting to their lit eracy. BtR to no avail. Instead, he was charged and Jailed for assaulting the female registrar. She accused him of shaking his finger at her arid of being boisterous. Walker denied these chfuges. His appeal to the State Supreme Court was lost on a technicality, although the Assistant Attorney General ques tioned the strength of the indict ment brought against him, The court threw out the idict ment charging disturbance of a registrar but did not deal with the question of constitutional rights. Walker and iiis two attorneys, Samuel S. Mitchell and Herman L. Taylor, therefore had no re course but. the United, States Su preme Court. So the case took on a new phase —it worked its way up to the highest court of the country and the citizens in the s>x-coun ty area took on a new attitude, a new interest, and a new determi nation. Attorney Walker and his colleagues were ready to fight. Mrs. Lassiter agreed. The people organized themselves. They pool ed their resources. They created the • Walker-Lassiter Defense Fund. The Walker-Lassiter De fense Fund, which is itself an outgrowth of (he Progressive Civic Union, was organized by leading citizens of the six county area. The Fund, with its offices in Weldon, also claims the assitanee of the Southern Conference Educa tional Lund, an interracial organization working to end segregation and discrimina tion in all forms. The main purpose of the Walker-Las siler Defense Fund is to fin ance the cost of legal actions involved in having the Unit ed States Supreme Court de clare the literacy tesa uncon stitutional, or, if not, accord ing to Dr. Moseley have the test ‘’spelled out.” Stalwart, Dr Alexander D. Moseley, the dynamic pastor of the First Baptist Church of Wel don, is the many-lettered lead er who presides over the activi ties of the Fund. Along with him are such men as Dr. Salter T Cochran, Jr., a. physician, the Rev. Mr. N. K. Dunn, pastor of Faithful Baptist Church. Plea sant, Hill, N. C., and Mr. Tiiomas H. Coefieid, undertaker of Wel don. Enthusiastic, selfless Dr. Mose ley finds his work with the Fund challenging and rewarding. He is determined to fight not only for the rights of Negroes but al so for the rights of all Ameri cans. “Because,,, says he. “A merica can never have the lead ership status she is supposed to have until all American citizens, regardless of race, color, or creed, will have equality and justice.” Dr. Mosley is convinced that a declaration by the Su preme Court will not only enable Negroes to vote, but will also en able America to have her place in the world. Brown High School in Winton. His college days saw him through Elizabeth City- State Teachers College. Before settling in Weldon, Dr. Moseley held pastorships in the Union Baptist Church of Tar boro, St. John’s Baptist Church of New Barn, and New Sawyer’s Creek Baptist Church of Bel cross. Ir is concerned ”in the general fight not only for Negroes but for the minority groups.’ - Dr Cochran feels that the people in the South are denied the basic privileges stated in the Consti tution of the United States. “They have been denied these privileges since the early twen-* tieth century.’’ he declares A native of Washington. D. C., he graduated from the Howard University Medical School and took up residence in Weldon thereafter. With his skill and modern office facilities, the young physician commands a large practice in Halifax Coun ty. Dr. Cochran married the former Miss Doris Hill, daughter of the dean of the School of Religion at Howard University. The Cochrans have two chil dren: a girl, Leslie, 2; and a boy. Anthony, 1. The Rev. Mr. N. K Dunn, pastor of Faithful Baptist Church in Pleasant Hill, N. C„ is no leas concerned about the voting privileges of minority groups than any of the afore mentioned lenders. He has al ways encouraged his congrega tion to register and vote. It no thing else spurred him la ac tion m tiie Weldon-Lassiter De fense Fund, this one fact did: Mrs. Louise Lassiter is not only a member of his church, but is an active member of the treas ury and the deacons’ board. Mr. Dunn knows her very well and has every reason to believe that she is eligible to vote. There arc other members of 1 s church whom he would like to see vote, too. So he is fighting because he thinks. "... we ought to have the obstacle removed so that Ne groes will have the same oppor tunity the white man has be cause of voting.” Mortician Augustus Coe field took up where his father left off. Augustus saw his father as a fighter of liberty and he has dedicated himself to the same cause. He thinks the fight must be positive if the underprivilegr ed groups are to achieve what for a lifetime they have been working for. These are some of the men who dream of human freedom Ift our time. There are other men such as, the Rev, Mr, C, Melvin Creecy, the Rev. Judson King, Arthur Poole, O. C Joyner, the Rev. C. L. Faison, Predinana Watson, Herbert Brown, W. R. Ricks, Willie Sykes and women such as Mesdames Cherry E. Clarke, and L. C. Boradnax, sec retary and assistant secretary of the Fund, respectively, who are dedicated to this particular phase of the struggle for free dom. There are also those outside of the six-county area, who. from Alaska to Hawaii, are lending support to the purpose of the Walker-Lassiter Defense Fund. Put them all together and there exists men of varied back grounds and vocational interests but of one common spark of en thusiasm, the brilliance of which have, no doubt, inflamed the hearts of the underprivileged, everywhere with a passion for equality, justice, and peace a mong the peoples and kindreds of the earth. r
