Torturing to Save Lives The reeent “Torture Report” al leges that the brutal interrogation teehniques used by the CIA in the aftermath of 9/11 were ineffeetive. But what if they did yield valuable information—would they have been justified? While the evils of terror must be eombated, human rights must also be proteeted. How are we to balanee these eom- peting values? How do we resolve the eonfiiet between maintaining national se eurity and the integral Ameriean ethie of proteeting eivil liberties of every individual? Using ease law, the Constitution, legislation, legal theory, Jewish legal perspeetives, and ease studies, Justiee and the War on Terror will analyze differ ent approaehes to this vexing dilemma. Prison Exchange In 2011, Israel set 1,027 prison ers free in exehange for the release of Gilad Shalit. More reeently, the rise of ISIS and the murders of James Foley and Steven Sutloff and others have foreed us to re visit this heart wrenehing debate: Should we pay hefty ransoms or release dangerous eriminals in ex ehange for the life and freedom of an innoeent hostage? Torture and the Ticking Bomb Just twenty years ago the de bate on the use of extreme meas ures in interrogations seemed theoretieal. With the War on Ter ror, they have beeome diseussions with real eonsequenees. This lesson will diseuss the legal issues from the perspeetive of U.S. law and eompare these JEWISH r.t'.'VKNiNO iNSTITlCTi; ^ findings with relevant eoneepts laid out in Talmudie law and eon- temporary Israeli law.
