Both pleaded no contest, but appealed to the next court with a motion to quash the charges. Judge Sherman A. Ross dismissed the motions. Un der an agreement reached with prosecutors, Lawrence and Garner again pleaded no con test. The judge fined them $200 each and al lowed the immediate filing of their new appeals. The case may end up before the US Supreme Court, because Garner and Lawrence’s chal lenges are based on state and federal constitu tional questions involving privacy rights. Depu ties entered Lawrence’s apartment on a false report of a person with a gun and found the men engaged in consensual sex. Fear of HIV test ATLANTA, GA—Some gay men say not wanting their names reported to the govern ment is one reason they avoid testing for HIV, a recent survey says. The Centers for Disease Control and Prevention (CDC) said the sur vey underscores the need to continue govern ment fimding for anonymous HIV testing, even as the agency asks states to start keeping names of people who get treated for HIV. The CDC surveyed 556 people in nine states in late 1995 and 1996 who were considered at high risk for HIV but said they had not been tested. They included homosexuals, intravenous drug users and heterosexuals recruited from clinics for sexually transmitted diseases. Nineteen percent said not wanting their names reported was one reason they had not been tested. Only 2 per cent said it was their main reason. Gay men living in states that report names were more concerned about privacy. Thirty-five percent of that group said name-reporting was one rea son they avoided testing. Still, the CDC found the most common reason for not getting tested was that people were afraid of learning they were HIV-positive. Father injects son with HIV ST. CHARLES, MO—Brian Stewarr, 31, has been found guilty of Injecting his 11- month-old son with HIV-tainted blood in what prosecutors charged was a scheme to avoid pay ing child support. Stewart was charged with using his position as a medical technician to steal tainted blood and then injecting it into his son while he was hospitalized. Police say suspicion fell on Stewart when he told his girl friend that she would never collect child sup port because the boy would not live that long. The boy, now seven, was diagnosed with fixll- blown AIDS in 1996. If the boy dies of an AIDS-related illness, Stewart could be charged with murder. The jury convicted Stewart of assault and recommended that he spend the rest of his life in prison. He is to be sentenced early in 1999. From “faggot” to murder PADUCAH, KY—In December 1997, Michael Carneal, a 15-year-old high school stu dent, brought a .22-caliber handgun ro school in his backpack. While not intending to mur der anyone, Carneal killed three female class mates. Carneal’s psychologists said his violent act came after months of anti-gay teasing and harassment based on his perceived homosexu ality, stemming ftom a supposed column in the school newspaper which said Carneal had a crush on another male smdent. School offi cials say they have no record of such a column. Carneal was sentenced to 25 years in jail with out parole. Gay official resigns WASHINGTON, DC-Bruce A Lehman, the openly gay assistant secretary of Commerce and commissioner of Patents and Trademarks, left his post December 31, ending his tenure as head of a 5000-employee government agency. In 1993, Lehman became the second of Presi dent Clinton’s openly gay appointees to be con firmed by the US Senate. Roberta Achtenberg, who served as an assistant secretary at the De partment of Housing and Urban Development, was the first. Lehman, an attorney, plans to return to the private sector. Stabbing is hate crime SAN ANTONIO, TX—In what police are classifying as a hate crime, a 22-year-old man was stabbed in the back outside a downtown gay bar, bringing to she the number of reported hate crinaes in San Antonio in 1998. The vic tim was getting into his vehicle outside a bar when he was approached by three men who, police say, stabbed him in the lower back. Po lice said the assailants then attacked two wit nesses about to get into their cars in the park ing lot of the bar. Police have made no arrests. MAD*s dumb list WASHINGTON, DC—In its year-end is sue, MAD Magazine listed “the 20 Dumbest People, Events, and Things of ’98.” Number 20 on that list was the anti-gay ad campaign which appeared last summer, urging gays to change their sexual orientation through prayer. In MAD's article, a self-proclaimed “former homophobe” testifies that it is possible to come out of homophobia and to stop voting Repub lican. The “ad” is putatively sponsored by the “Alliance Against Gary Bauer and Other Intol erant Little Twerps” and other satirically-named groups. Shepard site attacked WASHINGTON, DC—The bulletin board of the Matthew Shepard Online Re sources web site (http://www.wiredstrategies. com/wwwboard) was shut down in December as a resulr of a coordinated attack by thousands of anti-gay fans of pro-wresder Mick Foley. Foley’s supporters, angered that the slain stu dent was winning a Time magazine online poll for “Man of the Year,” overwhelmed the board with a continuous onslaught of anti-Shepard and anti-gay messages, requiring the site to be temporarily shut down. Gay bank on the net PENSACOLA, FL—Pending regulatory ap- provd, the Gay & Lesbian Bank will begin operation this spring, offering a “comfortable place for gays and lesbians to bank,” pledges chairman Steven Dunlap. Dunlap is an entre preneur who made his fortune developing nov elty items such as Pet Peeves, a talking collar for cats and dogs, and Moonies, a suction- cupped doll that attaches to a car window and See NEWS3 on page 25 Restore your vehicle to near-new condition • CHIPS • • SCRATCHES• • BUMPERS • More economical than body shops Call For Appointment Today!
