The question has come up of late,
as to what is the right of the student
in the event that an Administrator
decides to search his room. The Rid-
gerunner posed this question to the
Vice- Chancellor for Student Affairs,
Dr. lovacchini.
It would seem at first glance, that
there is no set policy either on the
University level, or in the courts that
determines the right of University
Officials to search dorm rooms. Dr.
lovacchini stated that while dorms
were to be considered on the same
level as an apartment or home, the
University maintains the right of
control. This means that the Dean of
Students, the Housing Director, and
the Campus Police have the right to
make reasonable searches. As yet
there is no clear cut definition of a
reasonable search. Due to this lack of
set policy, the University has let it
self be put in the position of pos
sible suits being brought * against
them. Dr. lovacchini reminded the
Ridgerunner that nearly all of the
discipline administered on campus
is of an administrative nature. One
can surmise then that unless a stu
dent commits a serious crime, it can
be expected that the actions taken
will be delivered on the University
level.
As to the students riglit to deny
someone enterence to his or her
room. Dr. lovacchini stated that it
would depend a great deal on the cir
cumstances surrounding the denial.
He stated that in the case of the de
nial, the most obvious question wo
uld be why the student is denying
the official enterance. This could be
interpred to mean the same as den
ying a breathalizer test for drunk
driving, if you do not choose to take
it, it is considered an admittance of
guilt.
The other major question that
dorm students often ask is,“What
is the feasibility of giving 24 hour
notice before a room check. Dr. lov
acchini stated that there was no rea
son why there could not be some
sort of notice given. The Ridgerun
ner assumes that the matter will be
looked into, provided there is stu
dent input on the subject.
Dr. lovacchini also stated that the
possibilities of training programs for
future proctors and Room and Board
Contracts were being looked into. He
feels that with the addition these and
other ideas, dorm students would
have a clearer picture of what is ex
pected of them, and would resolve
many of the questions involved in
the rights of the dorm student.
