The Pendulum runishment Page 7 continued from page 1 Byers countered Smith’s argument by saying that Hutchins’ “spark of godliness ’ did not prevent him from killing. ’’Roger (Smith) got to know Hutchins as a human being,” Byers said. ”1 knew him as a legal case, so we’re coming from two totally different areas.” Byers added that the idea that the death penalty is immoral is a 20th century development. She supported this by quoting several biblical passages. Smith explained that the value society places on life affects how we behave toward one another. ”If we do not have self-worth then we have the need to control others, and murder is the ultimate act of control,” he said. Smith added that capital punishment represents the “de-value society puts on life” and this lowers our self-esteem. Byers argued that “we demean life” when we say it is allright to kill people. She added that at some point society must have the right to protect its citizens. ’’Without the death penalty, we have lost that right,” she concluded. Both attomys did agree, however, that the threat of capital punish ment does not deter people from attempting murder.
