Prior to the March meeting of the Board of Commissioners a Public Hearing was held
concerning the proposed ordinance change of Chapter 21, Section 9 through 9.3 concerning
nonconforming use.
Town Attorney, Ken Kirkman, explained that the proposed ordinance essentially has
three parts. The first concerns nonconforming structures which, as in the present ordi
nance, cannot be expanded but adds that if somehow the structure is damaged or destroyed
to more than 50% of its value it cannot be rebuilt. The second concerns nonconforming
use of a structure. Once it becomes nonconforming it cannot be increased in size and
MUST BE BROUGHT INTO CONFORMITY WITHIN 5 years. The third deals with the use of a non-
conforming lot. Such a lot can be used for building despite the nonconformity unless
the owner owns the adjoining lot. The owner must then combine the two to create a con
forming lot.
The only example of an existing nonconforming structure given was the Water Company's
use of a private house in a residential district for business purposes. The Water Com
pany, through its attorney, Mr. Wainwright, went on record as opposing only that part
of the change which requires that it be brought into conformity within five years.
Later, when the Board was in session the ordinance was passed unanimously.
Commissioner Blanchard reported that in cooperation with the Community Appearance's
beautification program, the Town would arrange for a heavy refuse pickup on the same
date. Also, the new plaque for the Wayne Cleveland Fountain has been ordered. It will
be made of granite. This one is designed to last.
Commissioner Gibson reporting on police activity announced that Officers McAllister
and Hamilton had completed 40 hours of criminal investigation training. Also, there
were 103 calls in February and 275 House Checks, 27 traffic citations.
