BREAK IN DEADLOCK IS EXPECTED THIS WEEK MACLEAN SIDES WITH FOLGER For Increased Equalizing Fund But Followers Run Rampant (or Sales Tax SEE LUXURY TAX (Special To The Herald) Raleigh, April 30.—The North Carolina General Assembly was dead locked, aparently hopelessly, the first of this week. However, since it is darkest before d*p-n. the light may break through and the deadlock may be broken, but it will be the unexpected. That is just what has been happening in the present session, and it may again in the one big problem before the law making body. Rays of light have come through the maze several times during the week past, butbefore hopes go too high, they were cut off and the dark ness was blacker than ever. Other rays may break through, and may end as abruptly, and some day, or night, the clouds may clear and order come out o. he chaos that envelops the General Assembly. The House appears fixed in its de termination to make effective the State support of the six months school term, and by means in large part by the general sales tax of one per cent on gross sales. The Senate seems just as determined, even with a smaller majority, to have the Fol ger-Grier plan of a $10,000,00 equal izing fund for school aid without lux ury or general sales tax, except for the one for one-tenth of one per cent, which is included in the Reve nue bill. The committees from the two Houses have struggled in vain for a solution. The Senate committee came back to the Senate to ask for in structions. That body immediately received a resolution to instruct them t osupport a commodity—a luxury— tax. The supporters of that resolu tion thought they had won over a | vote, enough to tie the Senate and I require President R. T. Fountain to J break the tie for that tax. But in winning one, they lost another, and the Senate, for the third or fourth time, voted down the luxury tax 26 to 24. Senator Frank Dunlap, of Anson, one of the conferees, tried to offer an amendment, a compromise, on which he thought all could agree, but Senator Rivers Johnson, confident the commodity or luxury tax instruc tion would be carried, refused to let it be introduced and cut off debates by the parliamentary weapon of “call-, ing for the previous question.” The next day the general sales tax proposal, for the third or fourth time was placed before the Senate, in the form of a resolution to instruct the Senate Conference committee to support it. Again it was lost, by the decisive vote of 32 to 9, several lot voting. Senator Dunlap's amendment, which was not offered, was a compro mise. By it, the Senate committee would have been instructed to Vote for the luxury tax, as an emergency, for two years only, and whether or not it should be continued would be left to a vote of the people in the next election. It would require eco nomies included in the Folger school bill to be included, thus reducing the cost of the schools. That was what the Senate MacLean measure advo eites turned down, not even learn ing of its provisions until later. In the House, a resolution was in troduced, seeking to have that body stop and investigate, getting addi tional facts and figures and all in formation possible, as to what the vsrious proposals would mean, in stead of continuing hard-headedly and determinedly In its course of the State complete support of the si* months terms. The House refused to *ot on it immediately, ending it to the finance committee, thus resisst i»g all efforts to modify the provis ions of the MacLean measure. “I’m broke, and I want to go home,” said Representative Halstead, of Camden, * MacLean measure supporter, in tailing upon his fellow-members to rtew the matter sanely and sensibly. The House and Senate have other differences which conference com mittees have been unable to compose. A deadlock developed in the bill to regulate public service busses and trucks, operated on regular schedules and another arose in the school at tendance-child labor bill, raising the minimum of education from the 4th to the 6th grade before a child is permitted to work. An unusual num ber of conference committees has been employed by this session ,the two houses balking at actions of the other. The bill providing for a re-organi zation of the Department of Labor and including women in industry, child welfare, statistics on industry and the industrial commission in its scope, has been enacted. The act en larges the work, making up for the printing and supply features taken over by the Division of Purchase and Contract. The justice of the peace bill, nearly 9 month late, has been enacted, thus naming several hundred justices whose trms expired April 1. Many of them have performed official acts and it is probable that a bill will be enacted to validate the acts of all ap pointed. The omnibus of education bill was also late in getting through and old boards in some instances performed such acts as electing coun ty superintendents just before retir ing. An act will probably be passed invalidating such actions, since they are not legal. The omnibus Confed erate pension bill was enacted last week. Reciprocity arrangements may now be made with other states, rela tive to license on cars operating in more than one state, through enact ment of the reciprocity law. Other laws enacted the past week include: Provisions for cities and towns to finance air ports and landing fields. Permit working of short-term pris oners in city and town streets. Allowing a refund of tax on gaso line used for mining purposes. Providing for additional jurors from another county, by judge's mo tion, rather than removing cases to other counties for trial. Amend the game laws to permit farmers to propogate game and re ceive some of the benefits from hunt ing on their property. Prevent the lapsing of insurance policies, paid by employers from wages, without due notice of failure to pay premiums, to the insured. Allow World War veterans, their families and beneficiaries under ad justed compensation certificates to obtain death and birth certificates from the Bureau of Vital Statistics without cost. New bills introduced during the past week passed 20 on the Senate and 25 in the House, or a total for the session of about 1880, more than 1290 in tlie House and about 590 in the Senate. Among the new bills are the following: Repeal the act creating the Board cf Chiropody Examiners. Provide for appointment of offi cers of State Highway Patrol by State Highway Commission, without rpporval of Governor. Directing tne state ouaru ux Health to make and enforce rules governing the sanitary conditions of all places handling foods, swimming and bathing pools or other places publicly used where an admission fee is charged. To fix the interest and discount rates which a State Agricultural credit or asociation may charge on agricultural loans. To provide for refund of tax on gasoline used for operating cotton gins grist mills and saw mills. Empower and direct municipalities to apply sinking funds to purchase of their own bonds when available. Regulate the salaries of appoint ive State officers. Enlarging the powers of the pre siding judge at criminal superior court terms. Requiring branch banks to include in their financial statements, state ment of amount on deposit and am ount loaned each branch. Joint resolutions requesting North Carolina farmers to reduce their to bacco acreage. Joint resolution to have 1,000 co pies of Local Government Law print ed and distributed to officials of counties, cities, towns and other units. Governor O. Max Gardner has been invited and has accepted the invita tion to adddress the Institute of Pub lic Affairs at the University of Georgia May 13 on “Re-organiza tion of State and County Govern ment.” The members of the Georgia General Assembly will attend the meeting addressed b y Governor Gardner in a body. He addressed a similar meeting at the University of Virginia last summer, sharing honors with Admiral Richard E. Byrd, North and South Pole explorer. Allsbrook, Trustee, record ed in the office of the Register of Deeds for Halifax County, North Carolina, in Book 389, at page 572, default having been made in the payment of the indebtedness thereby secured, the undersigned Trustee, will on the 27 day of May, 1931, at 12 o’clock M. in front of the post office door in the town of Roanoke Rapids, Halifax County, North Carolina, of fer for sale at public auction to the highest bidder for cash, the follow ing described real property, to-wit: All that certain lot or parcel of land with improvements thereon, ly ing and being in the Town of Roa noke Rapids, Halifax County, State of North Carolina, beginning at the intersection of the southern line of 4th Street with the west line of Ham ilton Street; thence southerly along the west line of Hamilton Street, 126 feet; thence at right angles westerly 125 feet to a point; thence at right angles northerly 125 feet to the south line of 4th Street; thence at right angles and along the south line of 4th Street in an easter ly direction, 125 feet to the point of beginning; being shown and desig nated as Lots Nos. 401, 403, 405, 407 and the northern five (5) feet of Lot. No. 409, according to a map or plot of the property of Roanoke Rapids Power Company, Roanoke Rapids, North Carolina, of record in the of fice of the Register of Deeds for Halifax County in plat book No. — at page —; and being the identical lot or parcel of land conveyed to the said J. W. Ross by deed of W. T. Councill and wife, dated March 19, 1927 ,and of record in the office of the Register of Deeds for Halifax County as aforesaid in book No. 877 at page 294, reference to which said map and deeds is hereby made for greater certainty of description. The sale of the above described property will be made subject to a certain prior deed of trust of J. W. Ross and Mary G. Ross, his wife, to the Southern Trust Company, Trustee, dated July 1, 1928 and re corded in the office of the Register of Deeds for Halifax County, North Carolina in Book 398, at page 1, se curing originally the payment of the sum of $5,000.00 and interest there on.
