Judge Okeys Rides But Files His Own Dissent FAIRBANKS, Alaska — Another j judge has upheld the constitutional right of parochial school pupils to a so-called auxiliary aid, while en tering a dissent to his own ruling. U S. District Court Judge Ver non Forbes ruled (Feb. 19) that Alaska’s 1955 schoolbus transporta tion law authorizes rides for all school children and in so doing conforms to the U. S. Constitution. But Judge Forbes added that he “firmly believes in the solid wall of separation of Church and State for the protection >f both" and that a decision such as his weakens that wall. He said his ruling was forced on him by a 5 to 4 decision of the U.S. Supreme Court in the 1947 Everson case. The nation s highest court then upheld as constitutional a New Jersey law providing trans portation for school children at tending nonpublic schools. The majority opinion made a distinction between direct aid to a religious institution, which it said would violate Church-State separa tion, and state aid to a child at tending a religious school, carried out for reasons of public health or safety, such as transportation. These are generally called auxili ary aids. An approach to the constitu tionality of auxiliary aid which wa- parallel to ‘.hat of Judge Forbes was taken February 2 in Oregon City, Ore., by Clackamas County Judge Ralph M. Holman. Judge Holman, in a case that is expected eventually to reach the U.S. Supreme Court, upheld the constitutionality of Oregon’s law, which provides that state textbooks can be lent to pupils in nonpublic schools, but he entered a “vigor ous dissent” to his own decision. He argued for his personal be lief that there is no- distinction be tween aid to a child and aid to a religious institution. He said prop er Church-State separation prin ciples were violated. FOR THE PACKAGE WITH THE LITTLE RED PIG1 THE HAM MAKES IT DIFFERENTI The Fairbanks case developed from a suit by Mr. and Mrs. Lawr ence Quinton to force Fairbanks Public School District buses to carry their daughter, Judy Kay, 11, from their home in suburban Col lege to Immaculate Conception School, Fairbanks. The Fairbanks board had re fused to do this. It has fought the Alaska transportation law since it was passed, and in 1957 threatened to cease providing buses because it objected to transportation of nonpublic school pupils. The threat was not carried out. Alaska law provides that for rea sons of health and safety and to facilitate compulsory school attend ance, transportation can be pro vided at public expense for all school children. The State Board of Education, acting with powers given it by the law, directed that school districts were to enter into contracts for the transportation of pupils who live more than a mile and a half from the school they attend. Judge Forbes said the law re quires that in those places where a transportation program exists, children attending nonpublic schools must be provided rides if they travel over the same routes and the same distinces as public school pupils. But, the Fairbanks district board issued its own directive that buses should not pick up elementary school pupils who live less than a mile and a half from a public school. President CATHOLIC COMMENT from around tha globo Commies Win Over Union Apathy LONDON — (NC) — Catholic trade unionists have been censured for their apathy in allowing com munists to control one of the na tion’s most powerful unions. The Universe, national Catholic newspaper, said that only about 17 per cent of the 230,000 members of the Electrical Trades Union, many of whom are Catholics, voted in their recent important election. Frank Haxell, a member of the Communist Party, defeated Jock Byrne, a Scottish Catholic, for the post of General Secretary. An outcry has resulted charging ballot-rigging in the election for the key post in a union whose skilled members hold strategic jobs throughout British industry. The Universe, however, said that little or no publicity was given to the fact that the alleged conspiracy was possible only because such a small number voted. “On such figures it is indeed possible for the communists and their left-wing sympathizers to ob tain majorities due to the apathy and lack of interest of the consider able majority of non-communist members in failing to attend branch meetings and vote,” it said. Skid Row Goes Egghead DETROIT — (NC) — Skid Row is taking on an egghead look. A second reading room, complete with books, magazines, a record player and classical disks, has been opened in the downtown loop dis trict. Father Clement H. Kern, pas tor of Most Hftly Trinity Church in the city’s old Corktown area, opened it (Feb. 15) after being en couraged by the appreciation ac corded an initial reading room last \ summer. The project’s purpose is to pro vide wholesome recreation for any one in the downtown district, which attracts a number of “drifters.” Business firms and individuals have donated facilities and money for the project. Burial In Anglican Cathedral LIVERPOOL, England — (NC) — Sir Giles Gilbert Scott, noted British architect and Catholic, has been buried within the precincts of the uncompleted Anglican cathe dral here. His work on the vast Protestant edifice spanned 50 years. He was buried in a tomb which he designed in 1949 after the death of his wife, a non-Catholic. He had received permission for his own burial beside his wife from the late Archbishop Richard Downey of Liverpool, who stipulated that serv ices be private. Father Richard Wright, O.S.B., pastor of St. Austin’s parish here, officiated at the brief ceremony for the 79-year-old architect, who had designed a number of churches and buildings for the Benedictines. Lay Catechists Work The Andes PUNO. Peru — (NC) — The Maryknoll Fathers have built up an organization of 1,950 catechists —mostly Indians—to help make up for the shortage of priests in this remote area of the Andes moun tains. The Maryknoll Missioners, who have been in charge of this area since 1942, say the key to the catechetical program is the mission training school. . A recent innovation here was the establishment of a catechetical bookstore. It supplies Catholic literature printed m Quechua and Aymara — primitive Indian languages still spoken by a majori ty of the natives in this area. Vatican-Turkey Diplomacy VATICAN CITY — (NC) — The Holy See has given its representa tive in Turkey full diplomatic status with the rank of apostolic internuneic, the equivalent of min ister plenipotentiary. He is Archbishop Francesco Lardone, 73, former director of ecclesiastical studies at the Cath olic University of America in Washington, D. C. Since June of last year he has been Apostolic Delegate to Turkey, a post once held by His Holiness Pope John XXIII. The Vatican confirmed in Jan uary that it was establishing full diplomatic relations with the re public of Turkey, whose tradition al secularistic policy had made such diplomatic relations difficult. Demands for diplomatic relations with the Holy See had increased recently in the Turkish press and Parliament The Turkish republic was cre ated in 1923 through the efforts of Mustafa Kemal Ataturk. Its secularism was directed against the Moslem religion, which had in Ataturk’s opinion impeded the modernization of the country. But this secularism affected relations with Christians also. Turkey has a population of 26 million, of which 250,000 are Christians. There are about 18,000 Catholics in the coun try. French Love St. Martin PARIS — (NC) — This will be the year of St. Martin in France. In 1960 there will be many pil grimages, celebrations and publi cations in honor of the 16th cen tenary of the introduction of the monastic life into France by St. Martin of Tours, the nation's pa tron. St. Martin’s community began as a hermitage at Liguge in 360 A.D. About 11 years later he was chosen Bishop of Tours, and served until his death in 397. The more than 4,000 churches dedicated to St Martin will be the scene of celebrations in his honor. Of the 38,000 registered com munities in France, 365 bear St. Martin’s name.
