ROBBED SISTER STATE. Governor Elrod Saya South Dakota Should Return Montr to North Carolina. EetiriDgGov. S. II. Elrod, in his address to the South Dakota legislature last week, denounced in emphatic terms the deal by which that state came in possession of about 125,000 through suit against the state of .North Carolina on bonds issued by that state during the carpetbag regime. South Dakota, Got. Elrod said, had no right to take the money, and the state university, to which it was given, should not have touched it, because it was tainted "I recommend," said the gover nor, "that the legislature pass an act carrying an appropriation to return the sum of $22,416 to the state ot .North Carolina. V e took it away from our sister state North Carolina simply because the law said we could. Might did not make right in this instance. If the state of South Dakota returns said sum to the state of North Carolina, it will do more to cement the states together than anything that has happened since the civil war. The ease of South Dakota vs. North Caroliua is the first of simi lar suits to be brought to compel the several states of the South that floated wildcat bonds during car petbag times and since repudiated them, to pay them with interest. An individual cannot sue a state, Dut one commonwealth can sue another commonwealth. Hence certain holders of bonds have en tered into partnership with the state to force payment. Judge Allen Keeps Record Straight. The Washington Post having in cluded the shooting of the Ashe ville fiend who killed five men, supposed to have been Will Har ris, in a list of lynchings, Judge Oliver H. Aiienjot the JSorth Car olina bench, writes the Post as follows: Editor Post: My attention has just been called to a statement made in your issue of December 30 last concerning the number of lynchings during the year 1906, in which the following occurs: "Ashe ville, Will Harris, quintuple mur der, shot." This case in no sense should be classed as a lynching, and does the people of Asheville an injustice. As a judge of the Superior Court, I had duly outlawed the man known as Will Harris after he had killed five persons on the streets in Asheville, and he was shot by a posse after he had failed to sur render and while he was firing up on his pursuers. Two men, masked, entered the home of a poor old woman aged 73, in New York last week, and after choking her until she consented to show where her little money was, they got the money,, and choked her into Insensibility, leaving her nearly dead. Percy Martin, who robbed a Pullman car on a Seaboard train near Norlina some days ago, for which crime J. C. Powley was also arrested, writes vountarilya full confession, eihonerating Pow ley. 1 He says in his confession: "My occupation was news agent on Chesapeake and Ohio Railway. Was discharged at Huntington, W, Ya., for drunkenness about three weeks ago. Went to Wash ington D. C, and from there to Richmond, Va. Stayed in Rich mond two nights and one day, stopped at Davis Hotel. On Sun day night, December 30, I took the passenger train on the Seaboard railway at the Union station, hav ing purchased a ticket to Norlina, and expected to go to Hamlet and get work. I was out of money and only had enough money to take me to Norlina. I got desperate on the train and started to kill myself and then decided to rob the passengers in the Pullman car. "At some point about twenty five miles from Norlina I got up and went back into the Pullman, captured the negro porter and made him lock the door of the Pullman and walk in front of me and told him to see what the pass engers had. I made one man on the left hand side of the car give me his money and got $138. I saw his diamond ring and got that, too. I got nothing else, but went to another berth on the same side and the last one in the car. I started tt, go to another berth and the man I robbed told me not to go into the berth as there was only a little boy in there. "The porter ran back to the lear car, and I suppose notified the con ductor, who came in. I threw my gun in bis face and made him go back into the other car. I follow ed on and vent out on the plat form, and found the conductor of the other ear at the door. I thought he had a gun and I shot him, but did it to scare him. "I jumped off the train and went two or three miles until I came to the Southern railroad and then walked to Summerville, and there saw a negro pumpman and gave him my pistol to let me dry my clothes. I got out of there at 3 p. m. and went to Norfolk. Stayed there until I left Tuesday over the Norfolk and Western to Lynchburg and took the Chesa peake and Ohio and came to Hunt ington. I only had about $60 when I got here and turned- over about $40 to ray wife and told her I had won the money." He Was Educated.
