The following is the full text of an j ordinance recently introduced at. a meeting of the Board of Aldermen ot I the City, ot Wilmington, "Jjut -which on objection - to , unanimous -pasaagu went over to the regular , ineeting1. of the Board in April: " Be it enacted by the Board of Alder men of the City of .''Wilmington; N. C. Section 1 That some : -'competent person be appointed to act as inspec tor of meters, whose, duty it 5 shall be to inspect and test such meters,' and " to carry out the , provisions of this ordinance. "Sec.- 2. That . such. .. appointment shall be made at the first meeting in June of each year by the Board of Aldermen, subject to thjfe power of such city authorities to remove such appointee in the manner provided for the removal of its other appointees and to fill the vacancy, caused by such removal. The compensation of such inspector aha,ll be $ per 'month, and it shall be paid by the City and such inspector shall upon his appointment take oath before the Mayor that ha will faithfully perform the duties here in imposed upon him, and shall give bond for $1,000,000 for the faithful discharge of his duties. ; i9ec. 3. The City shall provide and beep a suitable and correct apparatus for testing and proving the accuracy of meters by means of which appara tus all such meters shall be properly tested. v - ,v "Sec. 4: No meter in . service shall be required to be taken out for test, except where there is a doubt of its accuracy and upon the written re quest of the consumer as herein pro vided. "Sec. 5.'; That where any consumer, Sy meter, of electricity, gas or water, oubts the accuracy of such meter and desires to have the same-tested, w" v such consumer may file with said in spector of meters a written complaint of said meter and request that same be tested -and shall at the same time deposit witi the inspector the. sum of one dollar to cover the expense of taking out and replacing such meter, and thereupon it shall be the duty of such inspector as soon as practica We to accurately test said meter in the presence of and . jointly with the authorized agent of the furnisher, and also in the presence of the complain ant, if he so desires, and shall give both to the complainant and to the furnisher notice of time when test will be made and a wirtten report of sucn test. . "Sec. 6. That if upon such test the said meter is found to. be incorrect, In that it registers more than 2 1-2 per cent. too. fast, that is, more than 2 1-2 per cent, more electricity, gas or water than it should, then in that event said inspector shall return to , the' complaintant the said dollar de posit and the furnisher shall prompt ly' adjust and repair meter or furnish a correctly adjusted meter; and the . -company against whom the complaint is made shall pay the one dollar cost 'of testing same; but, if upon such test said meter shall not register more than 2 12 per cent, too fast, that is. more than 2 1-2 per cant than it ought to, the said one dollar deposit shall be retained by said inspector to cover the expense' of testing said meter. "Sec. 7. That if upon such test the said meter shall register more than 2 1-2 per cent; oo fast, as above de fined, the fumibher shall reimburse the complaintant at the rate at which the meter registers, too fast for a pe riod of one month back. "Sec. 8. That any such meter hav ing been tested and found to be not more than 2 12 per cent too slow and more than 2 1 2 per cent, too fast, as above defined, shall be considered correct, and such Inspector, shall so mark or stamp such meter, and shall ikeep a suitable record of same. "Sec. 9,That the said inspector shall keep a correct record of all .inspec tions and make a report, of same to the City Clerk and Treasurer once each month with all money collected by him for the said testing or inspec tions. . - !?ec. 10. That nothing in this Act shall be construed as to prevent any furnisher or electricity, gas or water .-.from having free access to the me ters. . . . . -; ' ' "'Sec. 11. That it shall be unlawful for any consumer or his agent to tam per with or in any way change tha meter or its connections so that h would not indicate the full amount of gas, electricity or water furnished.
