order in federal district court
here, dismissing the McDowell
County Negro school soureuation
suit. The Newton jurist pointed
out that the separate but equal
doctrine" figurine m the suit no
longer applies and he added that
the status must now be decided ;p

The suit was brought in 1953 a-

board did not maintain educa

County was received by both the
Vanee County Board of Educa
tion and the trustees of the Hen
derson City Schools here Monday.
An estimated 200 names were
signed to the petition to the city
board and that to the county
group consisted of about 400

The petitions presented to the
two boards were identical in text.
They cited the Supreme Court

that she intends to kill him.
