Th neighbors m the beau tiful Valley of the Cross were most tender and kind during the anxious days of watch ing, and when the dreaded end came at last the refined sympathy and christian kind ness knew no bounds, for it came from hearts that had suhVred likewise, and gave immeasurable comfort to the loving father and mother, and the little sister who had given up her playmateof ma nv n happy hour during the short life of four years, and the recipients of all the ten der sympathy, the loving thoughtfulness, the kindly bearing, the comforting ing words and the neighbor ly acts are most grateful therefor, feeling that t heir neighbors and other friends here helped them bear their sorrow bravely, God's spirit enabling them to say with Christ in (Sethseman, "Fath er, not my will but thine be done." On Monday, the 9th, the beautiful service ol the Epis copal church was read by the Reverends .William H. Har din and William R. Savage in dear old St.. John's church in Watauga county, and the burial took place in thgrave yard near by where sleep ma ny others awaiting that time when, in the words of t h e hymn, On the resurrection morning Sool and body meet agaro; No more sorrow, no more weep- No more pain. The Topic does not confine its search for news to the sur face of the earth. One day last week while searching through Home old books and papers in the cellar of The Topic building, we found a few that were of much inter est. Those who remember the days when the whole sections of the State were terrorized by the "Swamp Angels," as Lowery and bis infamous gang were ironically culled, will read with interest the following taken from the Wil mington correspondence of the New York Herald, Wilmington, N.C. Feb. 24. 1873. A report has reached here from Robeson county, via. Florence, S C, to the ef led that Henry Berry Lowe r.y, the chief of the late gang of outlaws, so long a terror to the people of that section, is not dead but probably now living in New York city. The person from whom this infor ma ticn rame is supposed to have been one. of the party who tried to intimidate one of the Herald correspond ents by threatening him with arrest by the civil authori ties while he was investiga ting the status of the out laws. He says that sin.-e the Lnmberton bank was robbed of some thirty, thou so nd dollars and the stores of that town of about ten thousand dollars' worth of goods, Elenry Berry Lowery has not been seen by any white person in the county. He asserts that the report of the death of the outlaw chief by the accidental dis charge of his own gun or by assassination by one of the gang are both false. He states however, that a colored man in his employment saw Hen ry Berry Lowery alive, well and armed cap a pie, after he was reported killed and while the Herald correspondent was still a captive with the gang. In order to confirm his as sertion he says that Rhoda Lowfry receives packages of clotting, jewelry and other articles by express from New York which must come from her husband, though proba bly through the collusion of a third party. There is very little credit given here to this report. The Hei aid's version of his death being generally conceeded to be coitect; but I give it for its worth, in the hope that i' the outlaw is a live he may b, captured and brought to justice. There is $10,000 offered by the State and $1,000 by the county for the capture of this famous out'aw dead or alive. Always Successful, When indigestion become chronic it is dangerous. The recent crime on t h e schooner Berwind, commit ted on the high seas, wherein it appears that several offi cers on the ship were mur dered by a mutinous crew, of whom three negroea are now in custody at Wilmington, brings to tbe public notice the difference between the State courts and the United States courts in thehandling of murder cases, for of course this crime committed on the hltfb seas, beyond the juris diction of any State, on nn American v?tse, cornea with in the jurisdiction of the Fed eral courts. The United States laws on the conduct of murder trials are very simple by compnri son with the State laws. The former do not recognize the various degrees of murder at all, and it is a fact thut the jury not only determines by its finding of facts the inno cence or guilt of the accused, but slso fixes the punish' ment if the verdict is guilty. The only penalties for mur der in Uncle Sam's courts are death and life imprisonment. In determining the guilt or innocence of a prisoner the jury also determines whether or not the dpath penalty shall be inflicted. If it says the prisoner is guilty, but shallnotsufferdeath.it on ly remains for the jnduje to pronounce the life imprison ment sentence. This takes from the shoul ders cf the district attorney some of the resuonsibilitieH that the StateSolicitor must bear, and transfers it in part to the jury. It rel:eves t h e judge mightily, for be does not have to determine the length of the prison term, as does the State judges in aas es, of second tiegtee murder or manslaughter. We art not exactly propar ed to say thut we consider the Federal way better than our Stute laws, but we ure ready right now to saj that it is our honest and deliber ate opinion that there would be fewer killings if a m a n knew that, unless he could prove justification he would either hang or vco to the pen itentirry for life; that there was uo chance of his gctlinn off with five years or t w o yeais.
