Each proposal shall be accom
nied by a cash deposit or a cer
ied check drawn on some bank
or trust company authorized to do
business in North Carolina, of an
amount equal to not less than five
percent or the proposal or in lieu
thereof a bidder may offer a bid
bond of five percent of the propos
al as required by G. S. 143-129, as
amended by Chapter 1104 of the
public laws of 1951, said deposit to
be retained by the owner as liqui
dated damages in event of failure
of the successful bidder to exe
cute the contract within ten days
after the award or to give satisfac
