Yates, the following or dinance is adopted: SALES AT PUBLIC AUCTION Be it; ordained by the Board of Al- I ilermen of Edenton: Section 1. —It shall be unlawful for any person, firm or corporation, whether principal or agent, who has not engaged in a permanent business within the corporate limits of Eden ton for a continuous period of at least twelve months next preceding, to sell, dispose of, or offer for sale within the Said City of Edenton at public auc tion, or to cause or permit to be sold, disposed of, or offered for sale in the City of Edenton at public auction, any goods, w-ares or merchandise, whether the same shall be their own property or whether they sell the same as agents or as employees of another, until such person, firm or corporation, by applying Jo the Board of Aldermen of the City pf Edenton shall comply with each of the following regulations and conditions: 1. —Procure a license from the Board of Aldermen by paying, as a license tax, the sum of one hundred dollars for each month or fraction thereof that said person, firm or cor poration may be engaged in conduct ing such auction sale. 2. —File with the City Clerk a com plete inventory of all such goods, wares and merchandise to be offered at public auction, to be verified under oath. 3. To file with said City Clerk a bond in the sum of one thousand dol lars, with good and sufficient surety, for the purpose of guaranteeing a compliance with the applicable terms of this ordinance and the faithful per formance of any contract made with the customers and purchasers at said auction sale; said bond to remain in full force and effect for the term of sixty days after the close of said auc tion sale for the purposes herein pro vided. Provided, however, that this section shall not apply to judicial sales or sale by executors and administrators, receivers, or assignees in insolvent and bankrupt estates; or to an estab lished business concern of the City of Edenton which is retiring from busi ness; or licensed pawnbrokers actual ly selling and disposing of goods duly and regularly mortgaged or pledged; or sales by mortgagors duly authoriz ed by the term of a bona fide mort gage or pledge. Section 4.—rxo person at any public auction of goods, wares, or merchan dise shall act as bidder or what is commonly known as “capper,” “boost er," "shriller,” or offer to make any false bid or falsely pretend to buy any article offered at said auction sale for the purpose of deceiving the persons attending said sale: nor shall any per son conducting said auction sale re ceive knowingly or permit to be made any false or “boosting” bids by any ; said “booster,” “by-bidder,” “shriller” or other person bidding for the pur pose of boosting the price of articles sold or offered for sale at said auc- ; tion sale. Section s.—lt shall be unlawful for any person running and conducting a : ! public auction sale within the City of | Edenton of any goods, wares, or iner- 1 j chandise to falsely advertise or repre ! sent the same to be bankrupt stock or ] falsely advertise or represent the , same as being imported, or to falsely ! represent the same as to brand, trade ! mark, quality, weight or texture. Section 6.—Any person, firm or cor poration violating any of the forego ing provisions of this ordinance shall be guilty of a misdemeanor, and, upon conviction, be fined not to exceed one hundred dollars, or imprisoned not to exceed thirty days. Section 7. Any person, firm or cor poration licensed to conduct any auc tion sale under the foregoing sections of this ordinance, and who has been convicted for the violation of any of the provisions of same, or whose agents, employees, and servants, en gaged in conducting said sales, shall be convicted of violating any of the said provisions, may forfeit license to further conduct said auction sale’ as I the Court or the Board of Aldermen j of the City of Edenton. re.ay elect. .
