Bar Association) ACCESSORIES TO CRIMES What is the difference between an accessory before the fact and an accessory after the fact in the law of crimes? Accessories to crimes are per sons not present at the scene of the crime but who are, never theless, punishable by our crim inal law. ' They are of two classes: accessories before the fact and accessories after the fact. An accessory before the fact is one who was absent when the crime was committed, but who counseled, procured or command ed another to commit it. It is essential that the person charg ed as an accessory before the fact should have been absent at the time of the commission of the crime. An accessory after the fact is one who, knowing that another has committed a felony, receives, relieves, comforts or assists the criminal in any manner to es cape arrest or punishment. Thus, a person who, knowing that an other has committed a felony,, conceals him or furnishes the criminal with an automobile or money, or other means of aid ing his escape, is an accessory after the fact. Merely suffering a felon to escape, by taking no 'steps to detain him or to notify the au thorities, does not make one an accessory: nor do acts of char ity which merely relieve or com fort a felon, and do not hinder his apprehension and conviction or aid in his escape. What is the punishment in North Carolina for persons con victed of being accessories to crir..3s? A North Carolina statute pro vides: “Any person who shall be convicted as an accessory be fore the fact in either of the crimes of murder, arson, burg lary or rape shall be imprisoned for life in the State’s prison.” Persons convicted as accessories liefore the fact in other felonies may be given a lesser punish ment.
