Bar Association) Hospitals Susie Smith was a paying pa tient in a hospital operated by a non-profit corporation. Due to the negligence of employees of the hospital she was seriously and permanently injured. May she recover damages from the cor poration? No. A non-profit or charitable institution is not liable for the wrongful and negligent acts of its employees. Susie Smith will be unable to recover from the hospital damages for her person al injuries. It has been said that this ex emption from liability on the part of charitable institutions rests upon grounds of public policy or upon the theory that the proper ty of a charity is a trust fund and that, the charitable objects should not be hampered by the wrong ful acts of those chosen to carry them out. The fact that Susie Smith was a paying patient is immaterial. Although the hospital made a profit on Susie Smith, it was not a private profit. The profit made on Susie Smith was used by j the charitable institution to care for the non-paying patients. This rtile of immunity from li ability for personal injuries ap plies not only to hospitals, but to a wide variety of charitable in stitutions, such as schools, col leges, orphanages and churches. The only occasion in North Carolina where a charitable insti tution can be held for the negli gent acts of its employees is when there is proof that it has not exercised reasonable care in their selection and retention. Would Susie Smith be able to recover damages from the em ployee of the hospital who negli gently injured her? Yes. Although the corporation that operates, the hospital is not liable, the individual or employee who caused the injury may be held responsible for damages. If the individual does not have property from which a judgment can be satisfied, there would be little use in bringing s uch a suit. Would Susie Smith be able to recover damages from a hospital ■ not operated by a charitable* in stitution? ■ Yes. Where the profits of the hospital, if any, are to inure to the benefit of private individuals, as stockholders or otherwise, the hospital is liable to patients for J injuries resulting from the negli- I gence of its nurses and other em ployees. A hospital, charitable or pri vate, is not liable for injuries re sulting from the negligence of its I nurses and other employees. I A hospital, charitable or pri- I vite, is not liable for injuries re- | suiting from the negligence of a j physician that has been employed I by the patient or someone other j than the hospital. The reason is I that their professional treatment I is not subject to the control or I direction by the administrative I officers or employees of the hos- I pital.
