' Murphy promises Cohen to pay him ten dollars if the X football team beats the Y football team, in consideration of which Cohen promises Murphy to pay five dol lars if the Y football team beats the X football team. The X football team defeats the Y foot ball team. May Cohen recover j ten dollars from Murphy in a court of law? No. The agreement is a wager or bet. It is void and illegal, i’he courts will not assist one in the collection of his gambling debts. Mills bet Gardner one huhdred dollars on the outcome of a foot ball game. Gardner’s team lost. Gardner paid to Mills the agreed me hundred dollars. May Gaid .er lecover the one hundred dol ars in a court of law? No. The bet was illegal. As a general rule, the law will refuse .o aid either party to an illegal I contract. It Will leave them /here it finds them. A party to an illegal.agreement :annot recover damages for a i jieach thereof, nor can he, when te has performed on his side, as t rule, rocever the performance .hat he has rendered or its value. 1 The result in such case is the en richment of one wrongdoer at the expense of the other; but the rea- 1 son is to deter parties from en- 1 teririg into il egal transactions. Alexander and Biggs made a, wager on the outcome of a foot- i ball game and each deposits the' amount of his promised payment with Craig as a stakeholder, j \lexander wins the bet. Before j the money has been paid over to j Alexander, Biggs notifies Craig lot to pay Alexander. Craig I nevertheless pays Alexander. May Biggs recover the amount of his I deposit either from Craig or Alex-1 ander in a court of law? i Yes. The loser may recover the amount he has bet from either the stakeholder or the winner. This set of facts is an excep tion to the general rule that the law will aid neither party to an illegal contract who repents be fore the contract is wholly car ried out may recover the money or goods he has given in perform ance if he gives a notice to this effect before the entire transac tion is completed. Biggs was fortunate in this case in getting to Craig, the stakehold er, before the money was paid to Alexander. If the stakeholder had paid the money to the win ner before receiving the notice of the loser’s repud : ation of the wager, the loser would have been unable to recover from either the stakeholder or the winner. i Hospital Patients] — Visiting Hours 10 to 11 A.
