Bar Association) Righl-To-Work Laws May a person be forced to join a union in order to hold 'his job under the laws of North Caro lina? No. North Carolina is one of nineteen states that has a so called “right-to-work” statute. The North Carolina statute! provides: "The right to live in-1 eludes the right to work. The exercise of the right to work must be protected and maintain ed free from undue restraints and coercion. It is hereby de clared to be the public policy of North Carolina that the right of persons to work shall not be de nied or abridged on account of membership or nonmembership i in any labor union or labor organization or association.” Any contract between an em ployer and a labor union which makes union membership a pre requisite to employment or con tinuation of employment is void under this statute. A violation of the statute is a criminal of fense. Any person who is de nied employment or deprived of continuation of his employment in violation of the statute may recover from the employer in a civil action such damages as he may have sustained by reason of such denial or deprivation of employment. The “closed shop” or “union shop” has been outlawed under the provisions of this statute. Both the Supreme Court of North Carolina and the Supreme Court of the United States have, sustained the constitutionality of the North Carolina statute. The Taft-Hartley Act, enacted by the Congress of the United States in 1947, regulates certain union activities with employers that are engaged in interstate commerce. Under this federal law compulsory union member ship is permitted in those in stances where the union leaders can persuade or force the union to sign a union shop contract. But the same federal law pro vides that employees may not be compelled to join a union in those states which have a “right to-work” statute. Under a 1951 amendment to the Railroad Labor Act, enacted by the Congress of the United States, a labor union and an interstate carrier, as defined by the act, are permitted to enter into a union shop agreement, notwithstanding the provisions of any state statute to the contrary. The federal statute, of necessity, supercedes the North Carolina “right-to-work” statute in this' Attention! The top leaders of labor unions are fighting bitterly to prevent their spread and to knock out those now on the books. Most employers are naturally in favor of these “right-to-work” statutes. They point out that becoming a member of a union or other organization should be a voluntary act; and that many workers are coerced to join a union by collective bargaining agreements between unions and employers, requiring them to do so or lose their jobs. Those opposed to “right-to work” statutes contend that un ions represent both members and non-members in a certified bargaining unit and that any benefits won by the union ac crue to all, and therefore all should pay. Unionism has un questionably done much for the working man. Many union mem bers have become incensed at what they call “free riders”— fellow employees who benefit from union gains without con tributing financially to their ac complishment. Laws banning union shop contracts, they say, encourage free riders. AT INSURANCE MEETING L. E. Britton, local staff mana ger of the Southern Life In surance Company will attend a management meeting at the Company’s home office in Greensboro on April 5, 6 and 7. Managers and staff managers from a three state area, North Carolina, South Carolina and Virginia, will be present for the meeting. The group will consist of 110 men. The content of the meeting will revolve around improved methods of recruiting and train ing of agents as well as service to Southern Life’s growing num ber of policyholders.
