‘Are divorces obtained in for
eign countries valid in North
Carolina?
Actually there is no statute
or court decision in North Caro
lina on this subject. There has
never been a case before the
Supreme Court of North Caro
lina in this area of our law.
The “full faith and credit”
clause of the Federal Consti
tution has no application what
soever to decrees rendered in
foreign countries. Their recog
nition in America is dependent
upon the nebulous doctrine of
comity. In other words, an
American court may, as a mat
ter of courtesy to some foreign
Country, recognize its decree of
divorce, but it is under no ob
ligation to do so; the decision
rests entirely within the sound
discretion of the court.
As a rule, a foreign divorce
decree will be recognized, not by
any reason of an obligation to
recognize it, but upon consid
erations of utility and the mu
tual convenience of nations. In
recent years American courts
have accorded, and in some in
stances have denied; recognition
to divorces granted in various
foreign countries.
No country can give extra
territorial effect to its own laws.
Each country has a rightful
and legitimate concern in the
marital status of the persons re
siding within its borders.
In Massachusetts the princi
ple of comity has been extend
ed to the recognition of a Turk
ish divorce even though the dis
solution of the marriage, under
Turkish law, was not effected by
a decree of court. In Turkey,
a marriage of two Christians be
comes automatically dissolved
when one of them embraces the
Mohammedan religion and mar
ries a Mohammedan. The Mas
sachusetts court said that the
innocent husband was free to re
marry in the United States.
Are the so-called, Mexican
“mail order” divorces valid?
These are divorces granted
Without the personal appearance
of either of the parties. They
are occasionally seen advertised
mi magazines and newspapers.
Such divorces are very general
ly denied recognition in the
United States that the Mexican
courts have no jurisdiction un
der the circumstances.

‘.'mail order” divorce, said: “The
procedure followed by the de
fendant in obtaining his divorce
against the complainant smacks
somewhat of a slot machine de
vice. However, instead of put
ting a coin in the machine the

All law, international or other
wise, compels us to recoil at
the thought of such procedure.”
Mexico is organized much like
the United States, with separ
ate states under a federal gov
ernment. Each of the several
states has its own set of di
vorce laws. Except for the
“mail order” type of divorce,
Mexican divorces are, generally
speaking, presumed valid in
this country until and unless
they are challenged and declar
ed invalid.
A foreign divorce always has
an element of risk when chal
lenged in another country.
