DAVID WHEELER ALLRED The chapel of Southeastern Seminary, Wake Forest, N. C., was the scene of a lovely for mal wedding Sunday afternoon, May 31, at 4:30 o’clock uniting Miss Ruth Ennis of Greensboro and David Wheeler Allred of Edenton. The officiating clergymen were the Rev. Thurman W. All ied of Edenton, father of the 1 bridegroom and Dr. Claud D. I Bowen of the First Baptist | Church of Greensboro, pastor of the bride. Miss Louisa Mclntosh Davis, college roommate of Raleigh was maid of honor for Miss Ennis. James Randell Allred of Eden ton was best man for his brother. Ushers were John Glen Clay ton of Roxboro, Edsel O. King of Raleigh, Clifford R. Clarke of Atlanta, Cl., and James P. Wall 111 of Greensboro. The bride wore a formal gown of candlelight peau -de soie appliqued with alencon lace and seed pearls and a matching lace coronet topped! gown of candlelight peau de loses. A bouquet of roses with an orchid center was her choice of flowers. Smith cannot bring an action against the X Insurance Company for the injuries he has received ias the result of the negligence or wrongful act of : Jones. The insurance policy is for the sole benefit of the insured, John Jones. The insurance company has merely obligated itself “to pay 'bn behalf of the irisured all sriths {tip to the maximum stip ulated in the policy) which the ihfcured shall be legally obli gated to pay as damages be cause of bodily injury or prop erty damages caused by acci dent and arising out of his ownership or use of the auto mobile.'” Such a coritract is properly a contract of mdemnty for money paid by the insured, i •rstther than, a contract protect- ’ ling the insured from liability to i the injured' person. Furthermore, there is in | many of thbse automobile lia-, bility insurance policies a clause expressly stipulating: “Nothing 1 contained in this policy shall giVe any person or organiza-1 jtion any right to join the com-j | pany as a co-defendant in anyj I action against the insured to determine the insured’s lia-' bility.” I In a number of states there. are statutes that have changed the law from what it is in North Carolina. Sam Smith’s remedy in North Carolina, if he cannot get a sat isfactory voluhtary settlement from the X Insurance Company, !is to sue John Jones. If he ob tains a judgment against John Jbnes, the X Insurance Com pany will then satisfy the judg ment Up to ,an amount not in excess of the sum stipulated in the policy. During the trial of the action that Sam Smith brings against John Jones, may there be evi dence introduced to the effect that the defendant has automo bile liability insurance? No. The fact that the defend ant carries indemnity insurance cannot be shown at the trial. It cannot throw any light on the question of negligence or other circumstances of the accident.
