Classified Service. Classified service shall include all regular full time employes of the Town of Edenton. Article 3. Appointments and Conditions ot Employment Section 1. Qualifications for Appointment. Appointments to positions within the city service shall be made on the basis of merit and fitness, and in accord ance with the provisions of this chapter and any rule which may be established under its author ity. All persons considered for appointment must be citizens of the United States of America and must meet the minimum entrance qualifications established for the class of position for which they apply. The personnel officer may prescribe general qualifica tions for all positions within the town service, or specific qualifi cations for any class of posi tions. which will promote the ef fectiveness of the service, to in clude but not be limited to re quirements of education, resi dent, age, sex, relationship to other municipal employee by blood or marriage, physical standards, criminal record and ability to furnish surety bond and may use any of these re quirements as a basis for re jecting or refusing to examine an applicant. The personnel officer shall prescribe the form of ap plication and the information to be contained thereon, and may utilize such test, examinations, and investigation as he deems necessary to determine the fit ness of an applicant for a par ticular position. Section 2. Probationary Per iod. All original and promo tional appointments shall be for probationary period of six (6) months. An employee serving the probationary period for an original appointment may be dis missed by the appointing auth ority at any time. An employee serving the probationary period for a promotional appointment may be demoted by the appoint ing authority to the class of po sition or similar class from which promoted. Section 3. Suspension, Demo tions and Dismissals. (a) The appointing authority, for disciplinary purposes may ' suspend an employee without pay for not more than thirty (30) days during any fiscal year, or may assign additional work without additional compensa tion. (b) During the investigation, hearing or trial of an employed on any criminal charge, or dur ing the course of any civil ac tion involving an employee, and if in the opinion of the appoint ing authority, a suspension would be in the best interest of the town, the appointing authority may suspend the employee with out pay for the duration of the proceedings as a non-disciplin ary measure. Back pay shall not ordinarily be recoverable, but where the suspension is termin ated by full reinstatement of the employee, the Board of Council men may authorize full recovery of pay and benefits for the en tire or for any lesser period of the suspension. (c) The appointing authority may demote or dismiss any em ployee where, in his opinion, the best interest of the town, or the effectiveness of the town government will be served. In the event a reduction in force becomes necessary, consideration shall be given to the quality of service as well as the seniority in determining those employees to be retained. Section 4. Political Activity. No town employee shall take part in, nor contribute in any manner, directly or indirectly, in any election or function in volving the election of a candi date for office in the Town of Edenton, other than casting his secret ballot. Section 5. Dismissal Because of Outside Employment. The work of the town should have precedence over the other occu pational interests of employees. All outside employment for sal ary, wages or commission and all self employment must be report ed to and approved by an em ployee’s department head and the administrator. Conflicting outside employment shall be grounds for dismissal. Article 4. Grievances It is the policy of the town, insofar as possible, to prevent the occurence of grievances and to deal promptly with those which occur. When any griev ance comes or is directed to any department head. he shall promptly discuss all relevant circumstances with the employee and remove the causes of the grievance to the extent that he deems advisable and possesses authority. Failing resolution the grievance shall be carried to the administrator and to the Coun cilman in charge of the depart ment until a satisfactory solu tion has been reached or auth ority to deal with the situation has been reached and exhausted. 5. Resignation* Section 1. Notice Required. In order to resign in good stand ing, an employee shall give at least two weeks’ notice of his intention to resign. f£2ES Any town employee may be laid off without reflection on his stand in for lack of work or funds. The annual budget i adopted by the Board of Coun- ] 'cilmen and amendments thereto, • together with appropriation, : shall constitute the approval and i control by the Board of salaries ; and compensation. i Article 9. Vacations, Sick Leave, Holidays and Hours of Work Section 1. Vacations. Vaca- i tions shall be calculated on a calendar year (January-Decem ber) basis and shall be consid ered as earned by the employee at the rate of one working day per each full month of service and shall at no time accrue to more than the following days: (a) Street Department—Seven days. (b) Administrative Depart ment —Seven days. (c) Police Department Fif teen days. \ (d) Fire Department—Fifteen j days. I (B) Policemen, firemen, plant operators and other employees j who. by the nature of their work are required to work on Sundays . and holidays shall be allowed 15 . days annual vacation. I Vacations shall be taken at a ' time approved by the department jhead and administrator. (C) Vacations will not be ’' calculated during probationary period for new employees. \1 Section 2 Sick Leave. (a) Sick leave with pay (cal ’l culated on a calendar year basis) * is not a right for which town employees may make demands ; but is a privilege granted by the ’ Board of Councilmen. Where circumstances warrant, sick leave with pay may be granted by the administrator for each full time employee at the rate of one . working day for each full cal endar month of service cumula . tive up to 60 days. Provided further that in the case of em- L ployee receiving workmen’s compensation, leave must be ex , tended for the period covered by workmen’s compensation and : further provided that the amount ' of workmen’s compensation pay ment shall be included in the computation of full pay. (b) Sick leave which has al ready been accumulated to the credit of the employee as pro vided in Section 2. (a) Above may be allowed the employee in case of serious illness or death of any member of the family or dependent of such employee when, approved by the depart ment head and administrator; but such sick leave granted un der this paragraph ‘shall in no jease exceed 12 days. (c) To be eligible for sick leave with pay an employee must: (1) Report promptly to NOTICE! The Fee for Each Male Dog is SI.OO and $2.00 for Each Female. The Fee for Each Bicycle is 25 Cents. The Code of Ordinances Requires the Arrest of Any Dog Owner Who Fails to Purchase Licenses for His Dogs by August 15th. Claiming sick leave under false pretenses shall be cause for dismissal. (d) Separated employees who either resign, retire or are dis missed from town employment shall not be paid for accrued sick leave. (e) Sick leave will not be calculated during probationary period for new employees. Section 3. Holidays. Legal holidays observed by the city | shall be as follows: New Year’s! Day Easter Monday, Independ ence Day, Labor Day. Veterans Day. Thanksgiving Day. Christ mas Day. Section 4. Holidays Falling on Sunday. When one of the holi days enumerated above falls on Sunday, the following Monday will be observed as a holiday. Section 5. Hours of Work. The town administrator shall ; prescribe the office hours of the town government and the de- ■ partment heads shall prescribe the hours of work for all de partmental employees. Article 10. Leave o< Absence Section 1. Jury Leave. Any full-time employee of the town who is called for jury duty shall be granted leave of absence with /pay. I Section 2. Civil Leave. A municipal employee called as a witness for the federal on state governments or a subdivision thereof shall be entitled to leave ■ with pay for such duty during I the required absence. The em ployee may keep all witness fees received in addition to his regu lar compensation. However, law enforcement officers may not receive or keep any witness fees for appearing in a criminal court in connection with their official duties. Section 3. Maternity Leave. Sick leave shall not be granted for maternity leave purposes. Article 11. Miscellaneous Regulations Section 1. Physical Examina tion Required. Any employee of the Town of Edenton driving town vehicles will be required to pass a physical examination prescribed by the administrator and approved by the Council each year. Failure to pass this examination satisfactorily will constitute cause for transfer to some other position not requir ing the handling of town ve hicles and equipment. Section 2. Personal Indebted ness. It is expected that each employee of the town will keep his personal affairs arranged in such away that the town will not be embarrassed by excessive personal indebtedness. Section 3. Payroll Advances. It is the town’s policy to make payroll advances only in cases of serious illness, death or extreme emergencies. individually . ap proved by the department head. Section 4. Town Vehicles. Town vehicles will be provided to certain personnel for town business only. Town vehicles are not to be used for personal purposes. Arncie 12. Application and Effective Dal* Section 1. The above rules and regulations shall apply to all paid employees of the town of Edenton. Section 2. Effective Date. This ordinance shall take effect and be in full force from and after July 9, 1964.
