But slowly and gradually a fig ure began to emerge from this chaos: Hitler. He, and he alone, said Hitler, could save Germany, The form ation of the Nazi Party. His explosive oratory cap tured the .minds and imag ination of the German people when their fortunes were at a low ebb. Flag waving, marching, the goose step, pageantry, col or, smart uniforms, all of this was a godsend to the Germans. At last a saviour had arisen. They saw in all this a sinister thread being woven; yet they saw in Hitler, if only in expedi ency, the only way out of the morass of despair. It is true Adolf Hitler had a touch of genius in his makeup. But his genius lay on the podium, not on the battlefield. As an ora tor, he was a spell-binder, he could sway and move the masses, have them do his will and bidding. And that is where he should have left well enough alone. But Hitler, who thought himself another Alexander the Great, an other Bismarch, took over the supreme command of his armies, and thereby lost the war and brought about the downfall of Ger ! many and the destruction ! of Third Reich, which was to have lasted a thousand years. Whether or not you see in Adolf Hitler a ■genius or a mad man, or a little of both, don’t forget the concentration camps, the execution chambers, the Lidices. These, as someone has written, was Hitler’s only monument, his single, and infamous, contribution to history. Bar POUR-OVER TRUST Sam Scott delivered $1,000,000 to the Integrity Trust Company under a trust instrument dated January 10, 1960. The X College was made the beneficiary of the trust There was also a provision in the trust instrument re serving to Sam Scott a power of amendment. On August 5, 1963, Ben Bogert executed a will in which he bequeathed $500,- 000 to the Integrity Trust Company to be held as trustee “under the terms of a trust instrument dated January 10, 1960, executed by Sam Scott, and deposit ed with the Integrity Trust Company.” On April 1, 1965, Scott delivered to the Integrity Trust Company a written instrument amending the terms of the trust. Under the provisions of this amendment the Y College is made the beneficiary of the trust. Bogert died on March 10, 1967. Which college is en titled to the income from the $1,500,000? Under a statute passed in 1955 by the General As sembly of North Carolina, the Y College would be the beneficiary of the $1,500,- 000 trust fund. Unless the will provides otherwise, the bequest of the $500,000 operates to dispose of property under the terms of the trust as they appear in writing at the time of the testator’s death. May a person create a trust with himself as trus tee and reserving to him self the income for life and the power to revoke or amend the trust? Yes. The Supreme Court of North Carolina has held that a person may mani fest in writing an inten tion to create a trust with himself as trustee, retain ing the power to sell any part of the subject matter of the trust for his own benefit during his life time, with a further provi sion that the assets re maining in the trust at the time of the creator’s death shall pass to named bene ficiaries.
