PAGE FOUR Proceedings Os Town Council For The Month Os April Edenton, N. C., March 26, 1968. The Town Council of the Town of Edenton met this day in special session at 8 P. M. at the Edenton Mu nicipal Building. Members present: Mayor John A. Mitchener, Jr., l.uther C. Parks, David G. White, Leo Katkaveck, ,1. D. Elliott and Tom H. Shepard. Mayor Mitchener called the meeting to order and explained the purpose of the meeting was to receive recommendations from the Edenton Planning and Zoning Commission rela tive to a Zoning Ordinance change. R. G. White, chairman of the Edenton Planning and Zoning Com mission, presented the rec cmmendations of his Board and the only other person present was Marion Swin dell of Williford Funeral Home. Nothing in this ordi nance shall be construed to prevent the operation or es tablishment of off-street parking facilities, provided that such facilities are on or adjacent to, but not greater than 300 feet from, a commercial use. and pro vided that such facilities are to be used exclusively by that commercial estab lishment for the conveni ence of their patrons In no case shall an off-street parking facility be estab lished as an accessory use to a non-conforming com mercial use until after the THE CHOWAN HERALD. Members present: Mayor John A. Mitchener, Jr., Luther C. Parks, Henry G. Quinn, David G. White, Leo Katkaveck, Thomas H. Shepard and J. D. Elliott. Mayor Mitchener called the meeting to order and Councilman Parks gave the invocation. Chief of Police J. D. Parrish was directed by the Mayor to investigate the need for a stop light at the intersection of Albe marle and Oakum Streets. Robert W. Moore, execu tive vice president of the Edenton Chamber at Com merce, requested the Coun cil's permission to erect planters with suitable shrubbery on a block of the main business district. It is the intention of the Downtown Committee to test the reaction of this type of" installation ’withT the idea in mind of the Council continuing this beautification throughout the entire area, if accepted. Motion by J. D. Elliott, seconded by David G. White, unanimously carried granting the Chamber of Commerce permission to beautify this one block area. Mayor Mitchener made the following appointments to standing committees of the Town of Edenton: The Code and Ordinances Review Committee: Merrill Evans, Jr., Thurston Stal lings, J. B. Small, George A. Byrum and Roy L. Har rell. The Citizens Advisory Committee: Rev. Hubert Morris, John L. Spruill, Rev. George Holmes, Ern est Kehayes, W. E. Cox, | William Reeves, James C. (Pete) Dail, Henry Cuth rell, Dr. A. F. Downum, Mrs. R. E. Forehand, Ray mond L. Weathers and W. H. Creecy. The Housing Sub-com mittee of the Advisory Committee: James C. (Pete) Dail, John L. Spruill, William Reeves, Henry. Cuthrell, Raymond L. Weathers. The Mayor instructed the Administrator to advise the citizens of this appoint ment by letter. Motion by J. D. Elliott, seconded by David G. White, unanimously carried approving the following or dinance: An Ordinance Authoris ing the Mayor of the Town of Edenton to Pro claim the Existence of a State of bnergency and To impose Certain Re strictions Daring flu Be it ordained by the governing body of the Town of Edenton: Section 1. State of Emergency; Curfew Auth orized. (a) A state pf emerg ency shall be deemed to exist whenever, during times of greet public crisis, disaster,. rioting, catas trophe or similar public municipal public safety au thorities are unable to pubik mder^af VSST* journed. Weathers. existing or threatened state of emergency endangering the lives, safety, health and welfare of the people within the Town of Eden ton, or threatening damage to or destruction of prop erty, the Mayor of the Town of Edenton is here by authorized and empow ered to issue a public pro clamation declaring to all persons the existence of such a state of emergency, and in order to more effec tively protect the lives and property of people within the Town, to place in ef fect any or all of the re strictions hereinafter au thorized. (c) The Mayor is here by authorized and empow ered to limit by the pro- . clamation the application of all or any part of such lestrictions to any area specifically designated or described within the cor porate limits of the Town and to specific hours of the day or night; and to ex empt from all or any part of such restrictions law en forcement officers, fire men and other public em ployees, doctors, nurses, employees of hospitals and other medical facilities; on duty military personnel whether state or federal; on-duty employees of pub lic utilities, public trans portation companies, and newspaper, magazine, radio broadcasting and television broadcasting corporations operated for profit; and such other classes of per sons as may be essential to the preservation of pub lic order and immediately necessary to serve the saf ety, health and welfare needs of the people within the Town. (d) The Mayor shall proclaim the end of such state of emergency or all or any part of the restric tions imposed as soon os circumstances warrant or when directed to do so by the governing body. (e) During the exist ence of a proclaimed state ; of emergency, the Mayor, may impose by proclama- 1 tion any or all of the fol lowing restrictions: ? (![)- Prohibit or reguhke the possession off one’s own premises of explosives, firearms, ammunition or dangerous weapons of any kind, and prohibt the pur chase, sale, transfer or other disposition thereof; (2) Prohibit or regulate the buying or selling of beer, wine or intoxicating beverages of any kind, and their possession or con sumption off one’s own premises; (3) Prohibit or regulate any demonstration, parade, march, vigil or participa tion therein from taking place on any of the public ways or upon any public property; • (4) Prohibit or regulate the sale of gasoline, kero sene, naptha or any other explosive or inflammable Who pays... (f) Any proclamation may be extended, altered or repealed in any particu lar during the continued or threatened existence of a state of emergency by the issuance of a subsequent proclamation. (g) During the existence of a proclaimed state of emergency, it shall be un lawful for any person to violate any provision of any restriction imposed by any proclamation authoriz ed by this ordinance. Section 2. Severability. The violation of any provision of this ordinance, or of any restriction imposed by any proclamation authorized by this ordinance, shall con stitute a misdemeanor, pun ishable upon conviction by a fine not exceeding fifty dollars (SSO) or imprison ment not exceeding thirty (30) days, as provided by G. Be it ordained by the governing body of the Town of Edenton. Section 1. Definitions. For the purposes of this ordinance, the following terms shall have the mean ings herein ascribed: (a) “Molotov pocktail” is defined as any breakable container or any container which is designed in such a manner that upon being propelled it will at impact empty its contents, which i 3 filled with an inflam mable fluid or substance, and which is fitted with a fuse or wick. (b) “Fire Bomb” is de fined as any type of object designed or constructed so that upon being propelled it will explode or ignite its area of impact. Section 2. Prohibited Acts. It shall be unlawful for any person or persons to manufacture, possess, transport, or use any Molo tov Cocktail or other Fire Bomb. Section 3. Possession of Materials Restricted.
