PAGE EIGHT-B Zoning ‘Scale* To Balance Comm unity Br TED MXKALBEN Community Planner Zoning may be compar ed to a delicate scale which holds on one ram the rights of the individual property owner and on the other his responsibility to adjoining property owners and the town. This instrument is a sensitive device, but when properly contrived, will evenly balance the rights and responsibilities of all citizens. However ,if one citizen violates the rights of his neighbor or the legislative body does not act in the interest of the entire com munity, the scale is thrown out of balance. When a town is small, the balance is maintained by private agreements be tween neighbors. Y° ur L Social mi sum siciiitt Security Donald Morris, Field Representative of the Social Security Administration, is in Edenton every Thursday from 9 A. M., to 1 P. M., and is located in the Court House. There is a party operat ing in the Albemarle area who is representing himself as a Medicare worker or employee of the Social Se curity Administration. This information was recently reported to Robert Alford, officer in charge of the Elizabeth City Social Se curity office by residents of Currituck County. It appears that the intent of this party is to collect money from elderly people for medicare or a fee will get them an increase in so cial security benefits. Al ford said we have repre sentatives operating out of Elizabeth City social secur ity office who are author ized to accept money, but the representatives always carry identification or peo ple have been notified a social security representa tive will call on them. Alford cautions people of t'he Albemarle area not to give any cash to anyone who says they are a medi care worker or a represen tative of the Social Secur ity Administration. While it is necessary for some people to pay premiums for their medical insur spaces, the density of popu lation, and the location and use of buildings, structures and land for trade, indus try, residence or other pur poses.” Our forefathers were saying that it is sen sible to regulate the use of land and provided towns with the power to protect a nee benefits, these prem iums should always be paid by check or money order. For the added protection of the people, Alford advises that the check or money order should be made pay able to “Social Security Administration, Supplemen tal Medical Insurance Bene fits.” If anyone is approached by a person who cannot properly identify themself as a representative this should be reported to the social security office. In addition, it would be very helpful to the social secur ity office to receive a very good description of the person, including the type of car they are driving and the license number of the car. Also, people should call the social security of fice immediately when ap proached by a person who cannot properly identify themself as an employee of the Social Security Ad ministration. This will as sist the Social Security Administration and the lo cal authorities in appre hending the parties who are illegally collecting funds. the interests of the prop erty owners. North Carolina courts have generally supported zoning in the state. When challenged as unconstitu tional because it deprived an “ . . .appellant of his property without due pro cess of law—in contraven tion of Article I, Section 17, of the State Constitu tion ... ”, zoning was up held as a legitimate use of the police power. The same court stated further that “ . . the enabling act au thorizing cities and towns to enact zoning ordinances expressly recognizes the established principle of constitutional law that zon ing measures must find their justification in some aspect of the police power of the state exerted in the interest of the public" Zoning, according to this and other rulings, must promote the health, safety, morals and general wel fare of the community. If a town’s zoning ordinance deviates from promotion of the community’s general welfare, it is unconstitu tional and will be struck down by the courts. If zoning does not pro mote the general welfare, it will not stand in the courts or be supported in the community. If it is properly formulated, zoning is the proper balance which must be maintained be tween the right of the property owner to develop his land and his responsi bility to his neighbors.
