day in regular session at 8
P. M. at the Edenton Mu
nicipal Building. Members
present: Mayor John A.
Mitchener, Jr., Luther C.
Parks, Henry G. Quinn,
David G. White, Leo Kat
kaveck, Thomas H. Shep
ard and J. D. Elliott.
Mayor Mitchener called
the meeting to order and
Councilman Luther Parks

Town Attorney W. J. P.
Earnhardt, Jr., instructed
the Council that in his
legal opinion that only M.
L. Flynn, Virginia Road,
had any semblance of a
legal claim to the right-of
way recently used to widen
N. C. 32. He further stat
ed that even this claim
was questionable, but in
view of the fact that a
specified distance was men
tioned in Mr. Flynn’s deed
that he would suggest the
Council to work out some
agreement with him. Mo
tion by Thomas H. Shep
ard, seconded by Luther C.
Parks, unanimously carried
instructing Mayor Mitch
ener and Town Attorney
Earnhardt to meet with
Mr. Flynn and his attorney
to work out some agree
ment.
Merrill Evans and Hay
wood Jones presented a
preliminary plat for study
by the appropriate town
agencies for an additional
area in Morgan Park. Mo
tion by Thomas H. Shep
ard, seconded by J. D. El
liott and unanimously car
ried accepting the plat for
consideration requesting the
Planning Board and tlhe
Board of Public Works to
study this matter and to
give recommendations.
A request for garbage
pickup outside the corpor
ate limits by Byrum Im
plement & Truck Company
was denied even though
the implement company
1 agreed to pay a monthly
charge for this service. It
was felt by the Council
that this would create a
great number of problems
and on motion of J. D. El
liott, seconded by David G.
; White and unanimously
j carried, no trash or garb
age would be picked up
outside the corporate lim
its for any reason. The
Administrator was instruct
ed to write a letter to the
Chowan Medical Center in
forming them of this deci
sion.
Upon request by Town
Administrator W. B. Gard
ner and on motion by
Luther C. Parks, seconded
by Thomas H. Shepard
and unanimously carried
that the town buy a three
cubic yard trash container
to be placed at the sanitary
land fill and hopes that
the people using this area
would make use of this
container.
A request for use of a
right-of-way for construc
tion of a private road was
received from L. B. Horn
thal, Jr., representing
Frank Habit and Edward
Bunch. After numerous
questions the Council de
cided to turn tihis matter
over to the board of Public
Works for their study of
recommendations.
Town Administrator W.
B. Gardner presented a re
port to the Council of the
Cemetery Committee and
also a set of rules and
regulations given to each
Councilman for their study
and comments.
Tuesday, September 17,
1968, was set for a meet
ing with the Board of Pub
lic Works to discuss the
water shortage and also
possible water and sewer
extensions.
Motion by J. D. Elliott,
seconded by Henry G.
Quinn and unanimously
carried approving an on
premises beer license to E.
H. Williams at the Colonial
Motor Court.
Motion by Luther C.
Parks, seconded by J. D.
Elliott and unanimously
carried adopting the fol-
lowing resolution:
Be It Resolved that a
preliminary permit be filed
in behalf of the Town of
Edenton, together with the
other cities to be filed and
presented to the Federal
Power Commission with
reference to Document No.
E-7308 relative to develop
ment by cities of the Mar
bel Valley Pump Storage
Project, and that Phil
Audry be authorized to
file same on behalf of the
cities.
It was decided by the
Council that a traffri study
costing some $1,300 be
postponed indefinitely. A
request from the Edenton
City Schools for changes
in traffic patterns around
D. F. Walker High School
was presented and action
was tabled until a letter
requesting the changes
with further explanation
be presented.
Motion by J. D. Elliott,
seconded by Luther C.
Parks and unanimously
carried approving E. & W.
bills in the amount of
$59,848.29 for payment.
Motion by Leo Katka
veck, seconded by Henry
G. Quinn and unanimously
carried approving Town of
Edenton bills in the amount
of $27,057.71 for payment
as follows:
