In Setting Up Zoning

When the planning board
in any North Carolina city
prepares a zoning ordi
nance, it must act in ac
cordance with specified
guidelines. These guide
lines are designed to as
sure the legality of the or
dinance and assure that the
best interests of the entire
community are considered
and protected.
First of all, zoning must
be reasonable and uniform
in its application to all
properties of a similar
type. It must be legal and
conform to the plan for
future development. In
this way, the zoning ordi
nance will treat all types
of similar property equal
ly.
Secondly, zoning must
be general and not spe
cific. Within each resi
dential, commercial or in
dustrial district, a wide
range of buildings and
structures are permitted.
It is undesirable and il
legal to establish districts
which permit only a nar
row range of uses.

be made when it is dem
onstrated that such change
furthers the interest of the
community and the neigh

community development.
In this way property own
ers can be assured that
their interests will be pro
tected and that the pattern
of development will not be
lightly altered. Thus, the
value of property is stab
ilized, one of the most at
tractive features of zoning.
The fourth and most
important guidelines in the
determination of zoning or.
dinance and zoning map is
“Edenton’s Land Develop
ment Plan.” This plan,
the most economic, con
venient, safe and health
ful development pattern
for the town, is a most
important guide to zoning
changes. It serves as a
logical framework for mak
ing changes in the zoning
districts which will bene
fit the entire community.
Fifthly, zoning must
never grant special priv
ileges to selected indivi
duals. The process of
granting preferential treat
ment to a select class of
property owners is known
as spot zoning and has
been held illegal by the
courts. Thus, all classes
of property owners are
treated equally through
zoning.
Lastly, each district is
zoned for its most appro
priate use. Houses, with
all their auxiliary uses,
are located in one district,
while stores are located in
another district. Houses
are not located in an in
rustrial district because
the land is most suited for
industry. A great num
ber of compatible uses are
allowed in each district,
allowing the investor lati
tude in the use of his land.
