PAGE FOUR I—B Proceedings Os Edenton, N. C., I October 8, 1968. The Town Council of the Town of Edenton met this day in regular session at 8 P. M. at the Edenton Mu nicipal Building. Members present: Mayor John A. Mitchener, Jr., kuther C. Parks, Thomas H. Shepard, David G. White, Leo Katkaveck, Henry G. Quinn and J. D. Elliott. Mayor Mitchener called the meeting to order and Councilman Parks gave the invocation. Town Administrator W. B. Gardner explained to the Council that the con tinuing problem of dis posal of industrial waste at the land fill is increasing. He requested that some study be given this matter and Councilmen White, Quinn and Elliott were ap pointed to work with Mr. Gardner on this matter. A letter was read from the Highway Commission informing the Council that removing parking from Broad Street from Bridge Turn Service Station to :just north of the Triangle : intersection. Leroy Has kett, a resident of North Broad Street, presented a ■ petition objecting to the removal of parking on this street and a meeting with :Don Matthews and D. W. Patrick was requested by the .Council. Mr. Gardner was directed to arrange this meeting. It was fur ther discussed by the Council that this was op portune to press for con struction of the much needed U. S. 17 bypass and this was concurred in by members of the audience present. Town Administrator W. B. Gardner presented a re port on the rules and regu lations concerning opera tion of town cemeteries and upon motion by Thomas H. Shepard, seconded by J. D. Elliott, it was unanimous ly carried that the follow ing rules and regulations be adopted: Rules and Reg. 'ulations For Operation of the Cemeteries of the Town of Edenton The above motion also fixed the cost of grave -sites as follows: 1. _J3eaver Hill Ceme tery: $50.00 per grave . space. 2. Vine Oak Cemetery: $25.00 per grave space. The prices for non-resi : dents were fixed at double the above rates. Motion by Leo Katka : veck, seconded by Henry G. Quinn and unanimously carried directing the Ad : ministrator to advertise .for two 1969 police cars. Murray Ashley, speaking ion behalf of the Rescue Squad, requested the Coun cil for financial assistance :in paying for insurance on an ambulance. He further brought the Council up to date as to the activities of the past year. Mr. Gardner explained to the Council that it might be that residents of West Albemarle Street extended would be interested in an nexation by the Town and that further progress re ports would be forthcom ing. The report on Pembroke Creek dredging project was presented and accepted by the Council. The Council directed the town attorney, W. J. P. Earnhardt, Jr., to work with Frank Habit relative to the right-of-way re quest which has the ap proval of the Council and Board of Public Works providing certain safe guards can be incorporated. Mr. Gardner explained to the Council that there were some past due taxes and assessments that needed the legal attention of Mr. Earnhardt to assure collec tion. He stated that in or der to be fair to everyone, no one should be allowed to not pay either taxes or assessments. The Council agreed and directed Mr. Gardner to work with Mr. Earnhardt relative to this problem. Mr. Gardner also inform ed the Council that some merchants had not paid their Schedule B license taxes and after questions of legality by a member of the Council on motion by Thomas H. Shepard, sec onded by Henry G. Quinn, it was unanimously decid ed to take all necessary legal action to collect past ’ due Schedule B licenses. The report on public housing request was pre sented to the Council with the understanding that Edenton had been approv ed for 100 housing units. Motion by J. D. Elliott, seconded by Henry Quinn and unanimously carried directing that advertise ment on the old trash pile property as soon as the boundary agreement is drawn by our attorney. Motion by J. D. Elliott, seconded by Leo Katkaveck and unanimously carried approving the placing of one quarter page ad in the special edition of the Ber tie Ledger celebrating the bicentennial of the Town of Windsor. It was reported to the Council that the Adminis trative Ordinance Com mittee had studied the or dinance thoroughly and felt it to be adequate at this time. The Personnel Ordinance Study Commit tee felt that the personnel policy as it now is was sufficient except possibly in the area of incapacitated employees. They asked for further time to study this matter. The committee requested to study the raising and pay of the members of the Town Council and the Mayor pointed out that they felt the pay as it now stands is adequate compen. sation and recommended no change at this time. Members of the Council felt that further study needed to be given to the possibility of instituting a retirement plan in the next budget. He stated that S4OO was offered to Mr. Flynn for his portion on the dis puted property and he had been informed that this would not be acceptable unless the other two prop erty owners involved were paid a like amount The Mayor suggested payment of a like amount to Mrs. Bertha Bunch and West Leary. The Council re quested Mr. Earnhardt’s opinion in this matter. His position had not changed since the September Coun cil meeting and therefore the Council felt that an adequate offer had been made and no further ac tion needed to be taken. Resolution of the Town Council of the Town of Edenton; Whereas, on the 16th day of July, 1968, the property owners on that portion of Freemason Street lying be tween Granville Street and Bread Street filed with the Town Administrator a pe tition for improving said street in the following man ner: A sidewalk four feet in width on the north and south sides of Freemason Street from Granville Street to Broad Street, be paved with a substantial hard surface pavement and, Whereas, the Town Ad ministrator has certified to this board that said peti tion is sufficient in all re spects, the same having been duly signed by a ma jority in number of the owners who also represent a majority of all the lineal feet of frontage of the lands abutting upon the street or portion of a street above described. Now, therefore, be It re solved by the Town Coun cil of the Town of Eden ton: 1. That the above men tioned petition is found to be sufficient in all re spects. <2. That part of Free mason Street lying between Granville Street and Broad Street be improved in the following manner: A side walk in the area described above under and by vir tue of Section 160-78 of the General Statutes of North Carolina, 1943, as amend ed and the procedure there under. 3. That 50 per cent of the total cost of said im provements be hereafter assessed upon the lots abut ting directly upon the street or portion of the street described herein, ex clusive of so much of the total cost as is included in improving the street inter sections according to the extent of their respective frontages by an equal rate per foot of such frontage. 4. That the assessment herein provided for shall be payable in cash or if the property owner should so elect and give notice of the fact in writing to the Town Administrator in ac cordance with the provi sions of Section 160-92 of the General Statutes, 1943, as amended, he shall have the option and privilege of paying the assessment in 10 equal annual install ments. Said installments to bear interest at the rate of six per cent per annum. 5. That this resolution be published in The Cho wan Herald on the 31st day of October, 1968. Chairman Harrell outlin ed the pressing needs of the Water Department and also the needed water and sewer line extensions for the Edenton area. He pointed out that additional water storage and filtra tion facilities were needed immediately in view of the fact that during the past summer the town’s water supply was dangerously low. He also urged the extension of water and sewer to the site for the new Chowan Hospital which will serve an area beyond, water and sewer for the Paradise Road (cov ering Eden Heights area which will serve the area almost to Radio Station WCDJ) and water and sew er to the Morgan Park area to include the new area being opened for de velopment. The cost of the above mentioned items to tal over $650,000.00. Chair man Harrell urged the Council to take action to see that these plans were undertaken in the immedi ate future. Town Administrator W. B. Gardner explained to the Council and Board ef forts made by the town to secure a 50 per cent fed eral grant for the above mentioned projects. He HERE’S A RE AL FISH STORY... Clark, with the Department of Housing and Urban De velopment, had stated on the morning of September 17 that funds would not be available before January 1, 1969. Mr. Gardner was in structed to continue work toward the securing of federal grant money for this project. Motion by Thomas H. Shepard, seconded by J. D. Elliott and unanimously carried adopting the pro jects outlined above and urging the construction of same as soon as financial arrangements could be made. Mayor Mitchener was also instructed to con tact the Local Government Commission to arrange a meeting to discuss the town’s financing for this portion of the project. Motion by David G. White, seconded by Thomas H. Shepard and unanimous ly carried adopting the fol lowing: That the Town of Edenton will annex to the corporate limits any areas into which water and sew er lines are extended. The request for traffic change at D. F. Walker High School read by Sup erintendent F. L. Britt, motioned by Thomas H.
